INDIGENOUS LAND ACKNOWLEDGEMENT


We begin today by acknowledging the traditional territories of Indigenous peoples and their commitment to stewardship of the land. We acknowledge the communities in circle. The North, West, South and Eastern directions, and Haudenosaunee, Huron-Wendat, Anishnabeg, Seneca, Chippewa, and the current treaty holders Mississaugas of the Credit peoples. We share the responsibility with the caretakers of this land to ensure the dish is never empty and to restore relationships that are based on peace, friendship, and trust. We are committed to reconciliation, partnership and enhanced understanding.

    1. That the Minutes of the Council Meeting held on September 13, 2022, be adopted.

Summary from the City Solicitor
On September 17, 2020, the Local Planning Appeal Tribunal (the “Tribunal”) approved and issued an order regarding the settlement between the City of Markham and 2404099 Ontario Limited (JD Development Group) (the “Appellant”) with respect to appeals by the Appellant from the City’s failure to make a decision regarding applications for Site Plan and Zoning By-law Amendment for 7190 and 7200 Markham Road, located on the southwest corner of Markham Road and Denison Street.


The settlement permits the lands to be developed with two hundred fifty-six (256) townhouse dwellings and 11 flexible dual use units located along the Denison Street frontage.  The dual use units contain 1250 m2 of commercial space and are designed to serve commercial functions with permissions in the Zoning By-law Amendment that allow these units to be used as residential. The development will be serviced by a total of 404 parking spaces of which 393 are in an underground garage and 11 are at grade parking spaces.


The Tribunal approved the Zoning By-law Amendment that deletes the subject lands from the designated area of By-law 90-81, as amended, and incorporates them into the designated area of By-law 177-96 and zones them to permit the development outlined above.  As the Tribunal has issued its final decision and issued an order regarding the Zoning By-Law Amendment, that Zoning By-law now require assignment of a by-law number for administrative and municipal tracking purposes.

    1. That the following proclamations, issued by the City Clerk in accordance with the City of Markham Proclamation Policy, be received for information purposes:

Mayor and Members of Council:

  • That the report of the Development Services Committee be received & adopted. (Item 1 only):

    1. That the report titled, “ City of Markham – Age-Friendly Design Guidelines” be received; and,
    2. That the guidelines outlined in the “City of Markham – Age-Friendly Design Guidelines” (Appendix 1) be endorsed for implementation through the development review process; and,
    3. That Staff be directed to form a Staff Working Group to prepare a Request for Proposal and retain a consultant to complete a cost analysis of implementing the “City of Markham – Age-Friendly Design Guidelines” in the public realm and report back to Development Services Committee; and, 
    4. That the guidelines in the “City of Markham – Age-Friendly Design Guidelines” applicable to the public realm be implemented once the cost analysis is completed and presented to the DSC; and, 
    5. That minor amendments to the “City of Markham – Age-Friendly Design Guidelines” be made subject to the Development Services Commissioner’s approval; and further,
    6. That Staff be authorized and directed to do all things necessary to give effect to this resolution.

As per Section 2 of the Council Procedural By-Law, "New/Other Business would generally apply to an item that is to be added to the Agenda due to an urgent statutory time requirement, or an emergency, or time sensitivity".

    1. That the report entitled “Request for Demolition – Detached Heritage Accessory Building, 45 Jerman Street, Markham Village Heritage Conservation District”, dated November 8, 2022, be received; and,
    2. That Council supports the proposed demolition of the existing detached heritage accessory building at 45 Jerman Street, located within the Markham Village Heritage Conservation District, subject to the owner advertising the building for salvage or relocation for two weeks in the local newspaper or appropriate social media; and further,
    3. That Staff be authorized and directed to do all things necessary to give effect to this resolution.

That By-laws 2022-113 to 2022-118 be given three readings and enacted.
