Re:                      Town initiated Official Plan amendment to re-designate certain lands adjacent to the Legacy Community from High Density Housing to Medium Density Housing

THAT the proposed Official Plan Amendment to redesignate lands within the Legacy Community from High Density Housing to Medium Density Housing, be adopted.

 

At the December 7, 2004, Public Meeting regarding the above Don Hutchinson, President of the Legacy Ratepayers’ Association, made a deputation requesting two changes to the draft Official Plan Amendment (OPA): 

 

  1. Page 7, Paragraph 2: Change “predominately” single-detached to “all” single-detached
  2. Page 7, Paragraph 3: delete the reference to future development being more compatible with existing development, and substitute that future development be single detached dwellings.

 

It should be noted that the requested changes are to a non-operative section of the amendment.  With respect to the first point staff believe that the appropriate wording to describe development in the area would be as follows:

 

“The land surrounding the subject property is designated Low and Medium density housing and to date has been developed with all single detached dwellings.” 

 

This wording, included in the Official Plan Amendment, remains as current as possible in the event built forms other than single detached dwellings are approved in the area in the future.

 

The proposed wording in the second point is not appropriate given that it is inconsistent with the operative portion of the OPA, which designates the lands Medium Density housing and provides a variety of built form permissions.  However, staff acknowledge the compatibility concerns of the area residents and have modified the draft OPA to provide that the only permitted form of residential dwelling within 25 metres of the south boundary of the subject lands, (where it adjoins existing single detached dwellings) shall be small lot detached dwellings.

 

In addition, several other minor modifications have also been made to the preamble of the amendment (Section 4.0 of the OPA document).  All changes noted above have been reviewed and agreed to with Mr. Hutchinson.

 

Attached, is a copy of the public meeting minutes and a copy of the draft Official Plan Amendment, revised as discussed above, for adoption.
