	SUBJECT:	Reporting on In Camera Items

RECOMMENDATION:

That, to ensure essential confidentiality, all confidential reports contain a resolution containing the wording that is appropriate to be reported out in the public session.

PURPOSE:

To recommend a preferred alternative for public reporting out on confidential matters.

BACKGROUND:

In December 2003, the Finance & Administrative Committee directed that confidential items handled at the Standing Committee level were to remain confidential and be placed on the next Committee of the Whole In Camera agenda for final approval, rather than being placed on the public report of that standing committee on the subsequent Council agenda.

OPTIONS/DISCUSSION:

The requested process was implemented immediately but has resulted in situations where resolved matters are being discussed a second time and, on occasion, actually amended. This was not the intent of the Members of Committee and the process has caused some difficulties. The intent was simply to ensure it was appropriate to report out into the public session, not to re-consider matters. In addition, there is some uncertainty at the time matters are dealt with in Committee of the Whole In Camera meetings and this would eliminate the potential for reporting out on confidential matters before they have been finalized.

Staff is recommending that the following be added to every Standing Committee In Camera Report:

“- and further -

That the following resolution be reported out in the public session on this date.”

Staff is also recommending that the following be added to every Committee of the Whole In Camera report:

“- and further -

That the following resolution be reported out in the public Council meeting on this date.”

If it is appropriate for the entire resolution to be made public, the report should read as follows:

“- and further –

That the foregoing resolution be reported out in the public session/Council meeting on this date.”
