                                    Applications for Official Plan and Zoning By-law Amendments

RECOMMENDATION:

 

That the staff memorandum dated April 26, 2005, updating Council on the Official Plan and Zoning By-law Amendment applications by Al Hussain Foundation at 10992 Kennedy Road, be received.

 

And That the application to amend the Official Plan (revised 1987) to provide for a place of worship, be approved and the draft amendment attached, be adopted by Council without further notice;

 

And That the application to amend the zoning by-law to permit a place of worship, be approved and the attached implementing by-law, be enacted without further notice.

 

Applications were considered by Development Services on September 28, 2004

On September 28, 2005 Development Services Committee passed a resolution that recommended the draft Official Plan Amendment and Zoning By-law Amendment be forwarded to Council for adoption, once an exemption has been granted from the Greenbelt legislation. 

 

The Greenbelt Plan

The lands encompassing this Official Plan Amendment are not affected by the Greenbelt Plan boundary as identified by Ontario Regulation 59/05, under the Greenbelt Act (2005).  The Greenbelt Plan boundary forms the east boundary of the amendment area, encompassing a portion of the front yard and driveway, but does not include any of the existing building, proposed addition or parking.  The draft Official Plan and Zoning By-law amendments exclude any of the portion of the lands that are affected by the legislation and therefore, the amendment is in compliance with the Greenbelt Act (2005).

 

Next steps

The applicant is anxious to proceed now that the issues relating to the Greenbelt legislation have been resolved.

 

Following the approval of the Official Plan and Zoning By-law Amendment, staff will prepare a further report to Development Services regarding the proposed site plan application to permit the 183.5 m2 addition.
