SUBJECT:                          Shopping Cart Control Strategy

RECOMMENDATION:

 

WHEREAS shopping carts abandoned within the Town of Markham constitute a public nuisance in that they may be a traffic hazard, impede sidewalks and street maintenance, may be a risk to public safety and are unsightly;

 

NOW BE IT RESOLVED THAT the report entitled “Shopping Cart Control Strategy” be received;

 

AND THAT staff be authorized, as part of the Strategy, to conduct a Phase 1 communication and education program concerning abandoned shopping carts;

 

AND FURTHER THAT staff hold an information meeting in the Fall of 2006 and report back to Council early in 2007 on the Shopping Cart Control Startegy, includign a shopping cart control by-law to replace By-Law 278-97.

Staff proposes a three-part strategy to control shopping carts. The first part will incorporate a communication and education program and will gather input into the proposed shopping cart control by-law.  The second part will be the implementation of the proposed shopping cart control by-law.  An enforcement program will form part of the proposed strategy.

 

Three-Part Strategy

1.    Communication and Education

The first component of the recommended strategy is to communicate with Markham’s businesses the Town’s plan to control shopping carts.  Components of the communication and education program will include the following;

 

·         educating businesses on the nuisance and hazard potential of abandoned shopping carts,

·         notifying businesses that the Town plans to issue a fine to the owner of any abandoned shopping cart it retrieves and to charge a retrieval fee for the return of collected shopping carts

·         notifying that the Town plans to require that all carts bear clear identification and contact information to be used for notifying businesses of any abandoned shopping carts

·         gathering stakeholder input toward the development of a comprehensive shopping cart by-law and enforcement program

 

Staff proposes to hold an information meeting in the fall of 2006 and to report back to Council early in the new year on a shopping cart by-law to replace By-Law 278-97.

 

2.    By-Law Review

The second component of the recommended strategy is to enact a specific shopping cart control by-law in the new year and to repeal the existing By-Law 278-97.   The proposed by-law would be developed with stakeholder input, gathered through the communication and education phase, and may include the following provisions;

 

 

3.    By-Law Enforcement Program

The third component of the proposed shopping cart control by-law is an enforcement program that will not take effect until 2008.  The enforcement program will be developed with stakeholder input, gathered through the communication and education phase, and will allow affected business sufficient time to come into compliance with the proposed shopping cart by-law. 

 

Shopping Cart Management on Private Property

The Town has the authority, under the Municipal Act, to legislate that shopping carts cannot be abandoned on public or private property but not to legislate how shopping carts are managed within private property in order to prevent them from being removed.

 

Pending the approval of this report, staff will investigate opportunities for managing shopping carts on private property through the Site Plan Control process.
