RECOMMENDATION:
That the Mayor and
Clerk be authorized to execute an agreement in a form satisfactory to the Town
Solicitor with The Town Homes of the Thornhill Village Inc. for the
relocation of the storm sewer required for Phase II of the
Thornhill Community Centre Expansion.
PURPOSE:
To obtain Council authorization for a storm
sewer relocation agreement from The Town Homes of the Thornhill Village
Inc. (THTVI) located at 300 John Street, Thornhill.
BACKGROUND:
On April 15, 2003, Council approved the
expansion of the Thornhill Community Centre.
The
existing storm drainage layout is located on property owned by THTVI, abutting
to the east and requires reconfiguration by the Town, at the Town’s cost, in
order to accommodate the proposed addition. It is necessary to obtain an
agreement with the adjoining neighbor to permit the Town to construct the storm
sewer relocation work and provide indemnity with its work.
The cost for storm sewer relocation work is
included in the Phase I expansion tender currently in progress.
The property owner has agreed to the re-construction
of the storm sewer as presented on the attached sketch. Staff have obtained a letter (copy attached
as Appendix 2) from the adjacent owner’s consultant agreeing to the design of
the proposed works.
FINANCIAL CONSIDERATIONS:
None.
BUSINESS UNITS CONSULTED AND AFFECTED:
The
Legal Services Department will be involved in the preparation of an Agreement.
