1147389 Ontario Limited, Trustee - Release and Abandonment

of Storm Sewer, Sanitary Sewer and Watermain Easement

- Lot 66, Plan 65M-3397, Markham

RECOMMENDATION:

THAT a by-law be enacted authorizing the Mayor and Clerk to execute a release and abandonment of a storm sewer, sanitary sewer and watermain easement over lands legally described as Lot 66, Plan 65M-3397, in a form satisfactory to the Town Solicitor.

 

PURPOSE:

To obtain authority to release and abandon a storm sewer, sanitary sewer and watermain easement over Lot 66, Plan 65M-3397.

 

BACKGROUND:

On March 23, 2000, 1147389 Ontario Limited (United Castan) conveyed a permanent rather than temporary storm sewer, sanitary sewer and watermain easement to the Town registered as Instrument No. LT1462734.  This easement was required pursuant to the Subdivision Agreement for Plan 65M-3397 and was required to temporarily connect the services from Isabella Street to Raintree Drive until such time as the roads were built and permanent sewers installed.

 

The Engineering Department have advised that this easement is no longer required as the flows have been diverted to the permanent sewers installed in the public road allowance. 

 

FINANCIAL CONSIDERATIONS:

None.

 

BUSINESS UNITS CONSULTED AND AFFECTED:

The Town's Engineering Department has agreed to the requested release and abandonment as long as the Legal Department gets confirmation from the developer's solicitor that the abandoned sewers have been removed from the ground prior to providing the required release and abandonment.
