Turning Circle and Part Lot Control Exemption By-law Blocks 78 and 82 and part of Blocks 79, 80 and 81,

RECOMMENDATION:
THAT
Council authorize the enactment of a part lot control exemption by-law for all
of Block 78 and 82 and part of Blocks 79, 80, 81 on Registered Plan 65M-2497;
AND
THAT Council authorize the acquisition of land for a portion of the terminus of
Tenbury Drive, legally described as part of Block 82 on Registered Plan
65M-2497, designated as Parts 15 and 17 on a reference plan to be registered,
for nominal consideration. Acquisition will be subject to an environmental
clearance, to the satisfaction of the Director of Engineering and in a form
satisfactory to the Town Solicitor;
AND
THAT adoption of the part lot control exemption by-law shall be conditional
upon conveyance of the required portion of the Tenbury Drive Circle to the
Town, to the satisfaction of the Town Solicitor.
PURPOSE:
The
purpose of this report is twofold:
i)
to authorize Council to
designate Block 78 and 82 and part of Blocks 79, 80, 81 on Registered Plan 65M-2497 as exempt from part
lot control to:
·
enable the applicant to
create two residential lots from these blocks; and,
·
to identify lands to be
acquired by the Town for completion of the
turning circle at Tenbury Drive in accordance with a draft reference
plan (Figure 3); and,
ii)
to authorize acquisition of lands by the municipality for completion of
the
BACKGROUND:
The
Town and Baif Developments Limited entered into a subdivision agreement in 1987
for lands in the
Gel
Don is now seeking to create two new residential lots, one fronting on
Verclaire and the other on Tenbury from the remaining blocks and part blocks.
In
1987, the extension of
OPTIONS/DISCUSSION:
Lands
conveyed by the Owner to the Town will be combined with the lands to be
dedicated by the landowner to the south (Avant Investments Inc.). A small
portion of boulevard remains be secured from the landowners to the east at 3882
Highway 7, at the time of redevelopment, to fully complete the Tenbury turning
circle. Staff are reporting to Development Services
Committee on the Avant Investments Inc. site plan proposal. Approval will be
conditional upon the land dedication for the Tenbury turning circle.
Creation
of two lots of the proposed size and configuration on the subject site is
consistent with the development pattern in the area and in accordance with the
applicable zoning. These lots were contemplated in the original plan of
subdivision and therefore have sewage and water allocation assigned to them.
The draft reference plan was circulated to internal staff and found to be
satisfactory.
FINANCIAL CONSIDERATIONS:
There
are no financial implications for the Town in this report.
ENVIRONMENTAL CONSIDERATIONS:
An
environmental clearance will is required for lands to be acquired by the
municipality for the lands to be conveyed to the Town.
ACCESSIBILITY CONSIDERATIONS:
There are no accessibility considerations to be assessed in this report.

The
application has been circulated to internal departments for comment which are
incorporated into the report.
