RECOMMENDATION:
THAT a by-law be enacted authorizing the Mayor and
Clerk to execute a release and abandonment of a turning circle easement over
lands legally described as Part of Lots 3, 6, 7, 11,
12, 13, 14, 19, 20 and Part of Blocks 33, 36 and 37, Plan 65M-3262, designated
as Parts 1 to 12, inclusive, Plan 65R-20601, in a form satisfactory to the Town
Solicitor.
PURPOSE:
To
obtain authority to release and abandon a turning circle easement no longer
required by the Town.
BACKGROUND:
On July 15, 1998, the Town entered into a Residential Subdivision Agreement with Hillstar
Estates Inc. for Plan 65M-3262. One of
the conditions of subdivision approval was the conveyance of a turning circle
easement where Anita
Drive, Rembrandt Drive and
Via Jessica Drive end. This easement was
obtained and registered October 8, 1998, as Instrument No.
LT1304549.
On
August 27, 2003, the Town entered into a Residential Subdivision Agreement with
Eden Oak (Unionville) Inc. for Plan 65M-3707 which plan abuts Plan 65M-3262 to
the south making the need for the turning circle easement redundant now that
the streets continue.

The Engineering
Department has confirmed that the turning circles have been removed and the
roads reconstructed.
