Proposed
Inspection/Enforcement/Registration Process for Two Unit Houses
Receipt of Request or Complaint
· Requests are received from
Landlords/owners, real estate agents, banks, etc.
· Complaints are received from
tenants, neighbours, concerned citizens relatives of
the tenant or Government Agencies.

· Fire Services enters the
request/complaints on to AMANDA, completes an inspection requisition, and
conducts a search of the assessment rolls to verify the owner and the date the
residence was constructed. If the unit
is determined not “grandfatherable, By-law Enforcement is notified and a
follow-up inspection to require compliance by removal of second unit, zoning
by-law amendment or court action is pursued.
· Regardless of the
“grandfathering” status, the Fire Prevention Officer is mandated to contact the
Owner to confirm an appointment to inspect both units.

An inspection is conducted of both units by the Fire Prevention
Officer. If no violations are noted than a letter of Fire Code compliance is
issued. However, if violations of the Fire Code are found the Fire Prevention
Officer completes a Notice of Violation or an Inspection Order.

The Fire Prevention Officer reviews the Fire Code or the Fire
Protection and Prevention Act and/or other applicable Zoning By-law and
Property Standards requirements and notes the appropriate violations and reviews
these with the Owner. The owner receives
a copy of the declaration form to be submitted to the Zoning Division of
Building Standards. Building Standards
and By-law Enforcement are notified through AMANDA of required follow-up
inspections or clearances

Buildings Standards and By-law Enforcement conduct inspections as
required to determine applicable Building Code and Zoning By-law and Property
Standards By-law compliance

To qualify the “grandfathered” two unit house, the owner must submit a
completed declaration form to the Zoning Division and obtain a notice of
compliance with applicable Bill 20 legislation.

Communications between the Owner, the Owner’s Contractor and the Fire
Prevention Officer, and By-law Enforcement/Property Standards Officer and
Building Standards officer as required would continue throughout the compliance
time period issued by each Department.

Each Department conducts a re-inspection at the appropriate time as
indicated on the Notice of Violation. A decision is made whether to extend the
compliance time or to proceed with court action if the owner has failed to
comply with the requirements. Typically four inspections are adequate to obtain
compliance.

Once compliance is obtained it is entered on the AMANDA system by each
Department
Approval
for Registration
·
Where a two unit house has fully complied with the Fire Code, Building
Code as determined applicable, the Zoning By-law and the Property Standards
By-law, it is eligible to be placed on the Fire and Emergency Service’s
Registry.
·
Where a two unit house has outstanding compliance issues, it is not
eligible for registration.
