Patio Extension – Jakes Pub & Grille

 

 

 


 

RECOMMENDATION:

That the request for a temporary 2000 square foot patio extension at Jakes Pub & Grille at 202 Unionville Main Street for Friday, June 3rd and Saturday, June 4th to accommodate an additional 204 people, with the hours of operation to be consistent with the current patio hours of 11:00 a.m. to 2:00 a.m., be approved;

 

And that the applicant secure the services of two Off-Duty Police Officers to maintain order;

 

And that Council grant an exemption to the Noise Control By-Law to permit a live band on Saturday, June 4th from 3:00 p.m. to 9:00 p.m.

 

And that “No Parking” signs be installed to indicate no parking will be permitted in the parking lot at the rear of the property.

 

PURPOSE:

To report and recommend on an application for a temporary patio extension at Jakes Pub & Grille, 202 Main Street Unionville.

 

BACKGROUND:

The existing patio located at 202 Main Street Unionville is 2000 square feet and accommodates 152 people.  The hours of operation on the current patio are 11:00 a.m. to 2:00 a.m.  This request is for a temporary patio extension of approximately 2000 square feet that would accommodate an additional 204 persons.  The applicant is requesting similar hours of operation for the temporary patio area.  The request was received as a communication at the April 4, 2005 General Committee meeting and referred to the Town Clerk to meet with Mr. Valianes to discuss issues with respect to the closing time, time assigned for clearing and stacking tables, parking, signage, and police involvement.  It was also agreed that Mr. Valianes of Jakes Pub & Grille would be invited to attend in delegation and he has agreed to do that.


OPTIONS/DISCUSSION:

The applicant advises that his intent in the extension is to allow people who will be lined up outside the patio area to enter and be seated in the space adjoining the existing patio.  There will be a live band on Saturday from 3:00 p.m. to 9:00 p.m. which is contrary to the Town’s Noise Control By-Law.  However, this type of activity is consistent with a number of locations during the various community festivals.  A report on policy for noise by-law exemptions is in the preparation stage and will include provision for the festivals.

 

The proposal is to utilize the driveway to the rear parking lot as additional patio during the two-day festival.  The street will be closed during most of the festival and consequently, the back parking lot will not be utilized.  Appropriate signage to that effect will be required.

 

The applicant also advises he will secure the services of two Off-Duty Police Officers to maintain order during the event. 

 

The application was circulated to both the Fire and Building Departments.  The Fire Department advise they have no problem with the proposal and the Building Department advise that, since there is no construction involved, they have no comment.

 

During the discussion at the General Committee level, a 10:30 p.m. closure was discussed with table clearing and stacking to be complete by 11:30 p.m.  That time frame is inconsistent with the 2:00 a.m. closure on the existing patio and all other patios located on Unionville Main Street.
