SUBJECT:

Noise By-Law Exemption- Markham Ribfest & Blues Festival- July 15th & 16th, 2005

 

 

 

 

RECOMMENDATION:

That Council approve an exemption to the Town’s Noise By-law 2003-137 to permit amplified music to be played during the Markham Ribfest & Blues Festival from 5:00 p.m. to 11:30 p.m. on July 15th & 16th, 2005 at the Markham Fairgrounds.

 

PURPOSE:

To obtain Council approval for an exemption from the Town’s Noise By-law 2003-137 allowing for the playing of amplified music from the period of 5:00 p.m. to 11:30 p.m. on July 15th & 16th, 2005 at the Markham Fairgrounds during the Markham Ribfest & Blues Festival.

 

BACKGROUND:

 

Requirements of Noise By-Law 2003-137

By-Law 2003-137, known as the Noise By-law, prohibits amplified music from being emitted from 5:00 p.m. to 7:00 a.m. each day.

 

Markham Ribfest & Blues Festival

This year will be the third annual festival conducted by the Rotary Club of Markham Sunrise. The event is held at the Markham Fairgrounds and features local and well-known international performers playing on an open air stage. Organizers are aware of the sound issues and have shown an ability to limit sound levels to levels that have caused no recorded complaints in previous years.

 

Festival organizers are in contact with York Regional Police regarding the event and will be providing immediate contact numbers for the police and staff should issues arise during the event.


 

Request for Sign Approvals

A request for approval of temporary signs is a York Region issue as the request pertains only to regional roads.

 

Public Notification of Event

The event organizers will be required to place an ad in a local newspaper to notify the public of the event and the noise exemption. Staff will also be copied the proposed advertising material for the event to confirm exemption time periods.

 

Recommendation for Approval

The event organizers are aware of the sound impact of the event on adjoining and surrounding residents and have demonstrated from their past events that the event can held without negative public impact. Approval for the requested noise exemption is recommended.
