Noise By-law Exemption and Road Closure

RECOMMENDATION:

That the Region of York be granted exemptions to the Town’s Noise Control By-law # 2003-137 as follows;

 

  • Hwy 7 between Kennedy Road and Markham Road

      -  to facilitate resurfacing operations and reduce the duration of traffic impact

    • August 1, 2005 to September 30, 2005
    • Exemption from 1900 hours to 0700 hours Monday night to Friday morning
    • subject to;
      • restricting construction activities during the morning rush hour (0700 hours to 0900 hours);
      • The Region implementing a traffic management plan;
      • The Region implementing a communication plan to advise motorists, businesses and residents;
      • the work to be carried out during the above hours shall be restricted to asphalt grinding, asphalt stabilization and paving;
      • noise levels emitting from the sight must meet Ministry of Environment Guidelines and Town By-Law 2003-137 (maximum 85 decibels);
      • floodlighting must be adequately shielded to minimize light pollution;
      • the Town has the right to rescind the exemption if the Region or its contractor fail to comply with the above conditions.

 

  • Warden Avenue between Highway 407 and Apple Creek Boulevard

-  to expedite the road reconstruction and reduce the duration of traffic impact

    • June 1, 2005 to November 30, 2005
    • Exemption from 1900 hours to 0700 hours Monday night to Friday morning.
    • Subject to;
      • Region implementing a traffic management plan
      • Region implementing a communication plan to advise motorists, businesses and residents
      • the work to be carried out during the above hours shall be restricted to asphalt grinding, paving and sewer construction;
      • noise levels emitting from the sight must meet Ministry of Environment Guidelines and Town By-Law 2003-137 (maximum 85 decibels);
      • floodlighting must be adequately shielded to minimize light pollution;
      • the Town has the right to rescind the exemption if the Region or its contractor fail to comply with the above conditions.

 

  • 16th Avenue west of Shorthill Avenue

-  to expedite road reconstruction operations and reduce duration of the road closure and impact on traffic

    • June 1, to June 30, 2005 for two weeks. Exact dates to be finalized by the Region
    • Exemption from 1900 hours to 2200 hours Monday night to Thursday night.
    • Subject to;
      • Region implementing a traffic management plan
      • Region implementing a communication plan to advise emergency services departments, motorists, businesses and abutting residents
      • noise levels emitting from the sight must meet Ministry of Environment Guidelines and Town By-Law 2003-137 (maximum 85 decibels);
      • floodlighting must be adequately shielded to minimize light pollution;
      • the Town has the right to rescind the exemption if the Region or its contractor fail to comply with the above conditions.

 

  • 16th Avenue Phase II Sewer between Stone Mason Drive and Woodbine Avenue

-  to amend the exemption approved by Markham Council on of January 28, 2003

 

(a) Shaft Locations

                        Location 1 - North side 16th Ave. opposite Longwater Chase (east)

Location 2 - South side 16th Ave. between Warden Avenue & Lockbridge Ave.

Location 3 - North side 16th Ave. between Woodbine Ave. & Rodick Road

            Exemption:

1900 Hours to 2300 Hours Monday to Friday from May 16, 2005 to August 31 2007 for shaft excavation and construction.

 

(b) Shaft Locations

                        Location 4 - North side 16th Ave. opposite Stone Mason Drive

Location 5 - North East corner of Kennedy road and 16th Ave.

            Exemption:

1900 Hours to 0200 Hours Monday to Friday from May 16, 2005 to August 31 2007 for shaft excavation and tunneling

0200 Hours to 0700 Hours Monday to Friday from October 5, 2004 to August 31 2007 for maintenance

-  The above exemptions be subject to conditions listed in January 28, 2003 Markham Council   resolution:

 

 

And that Mr. K. Schipper, Commissioner of Works, Region of York, be advised accordingly.

 

PURPOSE:

The purpose of this report is to obtain Committee and Council’s approval for exemptions to the Town’s Noise By-Law to allow extended hours of operation for the Region of York’s resurfacing of Hwy 7 from West of Kennedy Road to Highway 48, 16th Avenue reconstruction west of Shorthill Avenue and the reconstruction and widening of Warden Avenue from Hwy 407 to Apple Creek Boulevard.  The exemption is required for the Region’s contractors to work extended hours to reduce the duration of the projects and corresponding impact on traffic in the area. In addition due to the delay of approval for 16th Avenue Phase II Sewer (Stone Mason Drive to Woodbine Avenue) the Region has requested an amendment to the dates specified in Markham’s January 28, 2003 previous exemption and requested a two hour additional exemption at two shaft locations to advance the construction schedule.

 

EXECUTIVE SUMMARY:

The Region of York has a number of road reconstruction and resurfacing projects starting in June 2005. The normal working hours under the Town’s Noise Control By-law #2003-137 is 0700 hours to 1900 hours.  extended hours of operations will reduce the project duration, disruption to traffic and length of impact.

 

The Region has requested approval for their contractor(s) to work extended hours so they can incorporate such into their pending tender(s).

 

BACKGROUND:

Hwy 7 Resurfacing

The Region of York has advised that they have resurfacing and ancillary works scheduled for Hwy 7 (Kennedy Road to Hwy 48) from August to September 2005. The Region of York is proposing exemption from the Noise By-Law between 1900 hours to 0700 hours Monday to Friday morning to reduce the period of impact in the areas. The Region will minimize overnight operations in residential areas and will focus evening and overnight operations in commercial areas.

 

Staff recommends the exemption as it will substantially reduce the extent of time the project will impact traffic operations in the area. This is subject to conditions listed in the recommendations section.

                                   

Widening of Warden Avenue from Hwy 407 to Apple Creek

The Region of York will be reconstructing and widening Warden Avenue from Hwy 407 to Apple Creek Boulevard commencing June 1, 2005 and scheduled to be completed by November 30, 2005. The project will maintain four lanes of traffic daily from 0600 hours to 1900 hours; however short term lane closures will be allowed between 0900 hours and 1500 hours for the purposes of delivering materials to site. The Region of York is requesting exemption from the Noise By-Law between 1900 hours and 0700 hours. During this time the contractor will be allowed to close lanes (maintain one lane each direction minimum) to carryout asphalt grinding, paving and sewer construction.

 

Staff recommends the exemption as there is minimal impact to abutting properties and it will substantially reduce the extent of time to undertake this project and the impact of traffic operations in the area. This is subject to conditions listed in the recommendations section.

 

 

16th Avenue Reconstruction west of Shorthill Avenue

The Region has to reconstruct a portion of 16th Avenue west of Shorthill Avenue (between McCowan Road and Kennedy Road) to correct subgrade problems.  This will necessitate the closure of 16th Avenue for construction for two weeks in June 2005. Regional Council has approved the Temporary Road Closure to facilitate the work. The Region of York is requesting exemption from the Town’s Noise By-Law from 1900 hours to 2200 hours Monday to Thursday to reduce the amount of time the road has to be closed.

 

Staff recommends the exemption as extended working hours from 1900 hours to 2200 hours will significantly reduce the time of road closure which will have significant impact on traffic and abutting residents in the area. This is subject to conditions listed in the recommendations section.

 

16th Avenue Phase II Sewer

Markham Council approved an exemption to the Noise By-Law for this project January 28, 2003. As the Permit to take water was delayed, construction of this segment of the sewer has been delayed from a February 1, 2003 start up to March 2005. This represents a delay of over two years.  The Region is requesting that the Noise By-Law exemption of January 28, 2003 be amended to reflect the revised completion date of August 31, 2007.  In addition, the Region is proposing to extend the exemption at the Stone Mason and Kennedy Road shafts by 2 hours to allow tunneling activities to continue until 0200 hours to facilitate the acceleration of the construction of the sewer. All significant activities during this extended time period will be kept to mining underground with the occasional crane operation.  This will allow the reduction of the construction schedule by six months and effectively all works in the sensitive Robinson Creek area adjacent to Stone Mason Drive can be completed by September 2006 instead of March 2007.  This will benefit all parties concerned, and in particular, dewatering can be shut off sooner and all corresponding potential environmental impacts can be reduced.

 

Staff recommends the amendment to the exemption to the Town of Markham Noise By-Law as it will allow the Region of York and their contractor to complete the project over a shorter period of time and reduce the impact to the construction schedule dewatering program. This is subject to conditions listed in the recommendations section.

 

Financial Considerations

 

There are no Town of Markham financial considerations relating to this report.
