Jennings Gate Estates Municipal Water System

RECOMMENDATION:

That the Mayor and Clerk be authorized to execute all related documents necessary to give effect to this recommendation, in a form satisfactory to the Town Solicitor, for the acquisition of two easements located at 1) 6 Wilmont Court, described as Part 1 on a Draft Reference Plan prepared by Ken S. Bunton, OLS (plan to be deposited) containing an area of 242.1 square metres for the purchase price of $12,000 and 2) over lands of Hydro One, situated north of Major Mackenzie Road and being along the east side of a hydro corridor, described as Part 2 on a Draft Reference Plan prepared by Ken S. Bunton, OLS (plan to be deposited) containing an area of 143.6 square metres, for the total purchase price of $5,600 plus GST, in a form satisfactory to the Town Solicitor.

 

PURPOSE:

The purpose of this report is to request Council’s permission to acquire easements for installation of a water line over two properties as part of the Jennings Gate Estates Municipal Water System. The installation of this water line will finalize the project and provide a necessary loop in the system for optimum water pressure and quality to the residents of the subdivision.

 

EXECUTIVE SUMMARY:

The Jennings Gate Estates Municipal Water System project was awarded by Council at its meeting held on November 25th, 2003 at a total cost of $1,047,290. Included in the project cost was the provision to acquire easements in order to loop the water main, over Hydro One and privately owned lands. The water main has now been installed in the municipal rights-of-way.


 

The final stage of the project includes installation of a water main along the south side of property situated at 6 Wilmont Court and then northward along the Hydro One service corridor for connection into an existing water supply line. Staff has negotiated with land owners for the required easements and is seeking Council authority to proceed with finalization of the conveyances.

 

BACKGROUND:

The Jennings Gate Estate Municipal Water System project initially involved two proposals for looping the water line. One loop feeds the system from the south-west corner by a proposed easement through #8 Jennings Gate (second lot north of Major Mackenzie Drive), across the Hydro One land and then connects to the water main in the Grand Life Boulevard Subdivision. The second loop is at the north-west corner, through a proposed easement at #6 Wilmont Court, turns north along the Hydro One land and connects to the existing water main north of Jennings Gate Estates. The second loop is the preferred option, providing optimum performance of the water system. The Manager of Real Property was engaged to negotiate the acquisition of easements over property located at 6 Wilmont Court and over lands belonging to Hydro One.

 

The easement over 6 Wilmont Court is shown as Part 1 on a Draft Reference Plan prepared by Ken S. Bunton, OLS (plan to be deposited). It contains an area of 242.1 square metres. The owners, Leon Hui, Johnson Lee and Maryann Lee have agreed to sell the easement to the Town for consideration of $12,000.The consideration was determined by an independent real estate appraiser.

 

The easement over lands of Hydro One is shown as Part 2 on a Draft Reference Plan prepared by Ken S. Bunton, OLS (plan to be deposited). It contains an area of 143.6 square metres. Hydro One had the easement independently appraised and have agreed to sell the easement to the Town for total consideration of $5,600 ($4,600 easement and a $1,000 administration fee), plus applicable taxes.

 

Prior to conveyance of the easements the Draft Plan will be deposited. The Town will also pay costs associated with conveying the easement over 6 Wilmont Court, including survey, appraisal and legal, estimated to be $3,500.

 

DISCUSSION:

It is anticipated that the work will commence on a date which is the earlier of 1) the owners providing to the Town permission to access and construct or 2) as soon as the easements are registered.


FINANCIAL CONSIDERATIONS:

The original project costs for the Jennings Gate Estates Municipal Water System included an allowance of $20,000 for easement acquisition and $8,000 for administration and registration fees. The total cost of these acquisitions will not exceed the original budget and will be recovered from residents.
