RECOMMENDATION:

That a by-law be enacted authorizing the Mayor and Clerk to execute the necessary release and abandonment of the watermain easement registered on title to the lands described herein, in a form satisfactory to the Town Solicitor.

PURPOSE:

To obtain authority to release and abandon a watermain easement.

BACKGROUND:

On March 26, 1998, the Town acquired a watermain easement from 1055097 Ontario Limited registered on lands legally described as Part of Lot 17, Concession 6, designated as Parts 2, 5 and 8, Plan 65R-19978 and registered as Instrument No. LT1257320.  Monarch Construction Limited registered Plans 65M-3343 and 65M-3582 and relocated the watermain easement into the Town owned Stonebridge Drive road allowance, being its permanent location.  This watermain easement is now an encumbrance on title to individual residential lots, a school block and a Town owned Park.
