A by-law to amend By-law 211-83 , as amended

(A by-law to prescribe a Tariff of Fees

for the Processing of Planning Applications)

 

 

THE COUNCIL OF THE CORPORATION OF THE TOWN OF MARKHAM HEREBY ENACTS AS FOLLOWS:

 

1.         By-law 211-83, as amended, be and the same is hereby further amended as follows:

 

            1.1       By deleting Schedule ‘A’ to By-law 211-83, as amended, and substituting therefor Schedule ‘A’ attached hereto.

 

2.         All other provisions of By-law 211-83, as amended, not inconsistent with the provisions of this by-law, shall continue to apply.

SCHEDULE ‘A’

TARIFF OF FEES FOR PROCESSING DEVELOPMENT SERVICES COMMISSION APPLICATIONS

 

 

PLANNING DIVISION FEES

 

·          Unless otherwise noted, Development Services Commission application fees are payable at time of application

·          For categories 1 to 3, cost of notifications for meetings and hearings will be charged back to applicant

1. OFFICIAL PLAN AMENDMENT

$3,800.00 per application

2. SECONDARY PLAN AMENDMENT

$3,800.00 per application

3. ZONING BY-LAW AMENDMENT

(i)   Amendment to development standards

$2,000.00 per application

 

(ii)  Removal of “H” (Holding) provision

$2,000.00 per application

 

(iii) Change in zone category or change in permitted use(s)

$3,800.00 per application

 

4. SITE PLAN CONTROL

 

(i) Residential

·         $700.00 per unit, except as noted below:

 

·         $700.00 per unit for an addition to an existing dwelling, except as noted in 4 (ii)

 

·         $150.00 per unit, if the applicable per unit planning processing fee has been paid through subdivision or consent process (e.g. site plan approval for single detached dwellings on new lots abutting existing residential development; site plan approval for street townhouse dwelling units).

 

In cases where the applicable per unit planning processing fee has not been paid through a subdivision or consent application for an individual site plan application, or a series of site plan applications by the same owner for an individual project, the site plan application fee shall be calculated and the fee collected as follows:

In cases, where site plan approval precedes subdivision approval, the site plan approval fee will be reduced in accordance with subsection 4(i) hereof, if the appropriate agreements with the Town are in place that specify subdivision approval and payment of the associated processing fees are required prior to commencing development on the subject lands.

 

(ii)  Residential Additions/ Alterations in Heritage Conservation Districts, Heritage Study Areas, Designated Buildings and in Heritage Estates:

·          less than 50m²

$65.00 per unit

·          50 m² or larger

$700.00 per unit

 

(iii) Industrial, Commercial, Institutional:

 

$3,800.00 per half hectare or part thereof of the subject property for any phase of a development; minimum fee $3,800.00.

 

(iv) Amendments to Site Plan Control Agreements:

$2,000.00 unless revisions require a new application and corresponding fees.

$1,300.00 for outdoor patio areas with an existing site plan control agreement.

 

Note: $1,300.00 fee for outdoor patios also applies where there is no existing site plan agreement and a site plan application for the patio area only is required.

 

(v) Amendment to Site Plan Control Agreements for Single and Semi-Detached Dwellings, and Townhouses:

$320.00 unless revisions require a new application and corresponding fees

 


 

 

PLANNING DIVISION FEES

5. PLAN OF SUBDIVISION

(a) Plan of Subdivision Application Fee: $10,000.00 per application (payable with application), plus;

(b) Plan of Subdivision Processing Fee:

(i)  Non Residential Uses

 

·         $2,800.00 per half hectare or part thereof for commercial, institutional and other non-residential uses (excluding park blocks, valleylands, hazard lands, environmental buffer blocks, stormwater management blocks and open space areas to be conveyed into public ownership) payable as part of the overall processing fee for residential draft plan applications.

(ii) Residential Uses*:

(i)  By-Law variance, change in legal non conforming, and zoning interpretation for residential properties: (excludes apartments and condominiums)- see also  Sec. 11 (iv)

(ii)  By-Law variance, change in legal non conforming, and zoning interpretation for all other property types, including apartments and condominiums

 

$1,500.00 per application

(iii) Consent

$2,000.00 per application; plus (iii) (a) or (b):

 

(a) conveyance creating a new residential lot

$550.00 per unit, payable prior to finalization of conveyance

(b) conveyance creating a new industrial, commercial, or institutional lot

$2,800.00 per half hectare or part thereof of the newly created lot, payable prior to finalization of conveyance; minimum fee $2,800.00.

(iv) Technical Amendments

Residential applications for variances to rectify existing conditions requiring minor review by staff, at the discretion of the Director of Planning - $650.00 per application

12. MINISTER’S ZONING ORDER AMENDMENT

 

(i)  Amendment to development standards

$1,200.00 per application

(ii) Change in permitted uses

$2,500.00 per application

 

13. EXEMPTION FROM PART LOT CONTROL

 

$3,800.00 per registered plan

14. ONTARIO MUNICIPAL BOARD EVIDENCE

$3,800.00 per hearing, payable prior to hearing

 

 

 

DESIGN DIVISION FEES (Landscaping Plan Processing Fees)

·          Unless otherwise noted, Design Division fees are collected at the site plan control execution stage or plan of subdivision registration stage.

1.      SITE PLAN CONTROL AGREEMENT

 

 

     (Short Form Version)

·         $1,400.00 per half hectare or part thereof of the subject property contained within the site plan agreement or 4.5% of the estimated cost of construction of the landscaping in the site plan agreement, whichever is greater; minimum fee is $1,000.00

·         Short Form Version - $260.00

·         Tree Inventory & Preservation Plan  - $260.00

2. SUBDIVISION AGREEMENT

·         5.5% of the estimated cost of construction of the landscaping works in the subdivision agreement.

 

 

ENGINEERING DIVISION FEES

 

·          Unless other wise noted, Engineering Division fees are collected at site plan agreement or subdivision agreement stage.

1. SITE PLAN CONTROL agreement

·         $700.00 per half hectare or part thereof of the subject property contained within the site plan agreement; minimum fee $1,000.00

·         Engineering fee not required for a short form version site plan control agreement

2. PLAN OF SUBDIVISION

(where a development agreement or pre-servicing agreement is entered into the Engineering fees are payable at that time)

·         4.4% of the final construction costs of public works within the plan of subdivision, as certified by the consulting engineer, where construction costs are greater than $100,000.00.

·         5.6% of the final construction costs of public works within the plan of subdivision, as certified by the consulting engineer, where construction costs are less  than or equal to  $100,000.00.

* Additional submission/review surcharge- An additional fee, based on $70.00 per hour of engineering review time will be assessed, at the discretion of the Director of Engineering, for excessive resubmissions of  plans or repeat site inspections by Engineering staff.

3. SERVICE CONNECTION

·         15% of the total cost of engineering work required within the municipal road allowance.

4. COMPLIANCE LETTER (Municipal Services)

·         $50.00 per property.

5. TOP SOIL REMOVAL PERMIT

(Fee with submission of application)

·         $280.00 + $30.00 per hectare or part thereof, to a maximum of $1,000.00.

 

 

TRANSPORTATION SECTION FEES

 

·          Transportation Section fees are payable with submission of study to the Town

1. REVIEW OF TRANSPORTATION & NOISE STUDIES

(I)Transportation Study

$3,200.00 per study or

$2,500.00 per study with approved terms of reference.

(ii) Noise Impact Study

$2,500.00 per study or

$1,800.00 per study with approved terms of reference.

(iii) Secondary Plan Transportation Study

$6,200.00 per study

 

 

 

TELECOMMUNICATIONS PERMIT FEES

 

·          Telecommunication fees are payable at the permit stage.
