SUBJECT:                          Proctor Avenue Culvert Replacement – Exemption to the Town of Markham’s Noise Control By–law #2003-137

RECOMMENDATION:

THAT the report entitled “Proctor Avenue Culvert Replacement – Exemption to the Town of Markham’s Noise Control By-law #2003-137” be received;

 

AND THAT an exemption to the Town of Markham’s Noise Control By-law #2003-137 be approved to permit water pumping operation for the Proctor Avenue Culvert Replacement project to proceed 24 hours a day, 7 days a week for the duration of 2-3 weeks between May 15 to June 30;

 

AND THAT the above exemption be subject to staff from the Asset Management Department and its consultant advising abutting residents on Proctor Avenue;

PURPOSE:


The purpose of this report is to seek Council’s approval to exempt the Town of Markham’s Noise Control By-law #2003-17 to permit water pumping operation for the Proctor Avenue Culvert Replacement project to proceed 24 hours a day, 7 days a week for  the duration of 2-3 weeks between May 15 to June 30.


 


 

BACKGROUND:


The existing 2.1m by 3.7m corrugated steel pipe culvert was originally located inside Proctor Park on the south side of Proctor Avenue, just east of Henderson Avenue.  The culvert was damaged by the August 19, 2005 rain storm.

 

This project involves the replacement of the existing 2.1m by 3.7m corrugated steel pipe culvert with a similar size concrete box culvert and  an outlet structure at the existing storm sewer outfall. 

 

On April 3, 2006, the CAO approved and awarded this contract to Esposito Bros. Construction Ltd.

 


 

OPTIONS/ DISCUSSION:


In order to implement the construction of the Proctor Avenue Culvert Replacement project and to maintain a dry site condition required by TRCA for construction activities, the storm sewer flow inside the existing channel has to be temporary diverted around the work area.  This diversion must be done by the use of pumps.

 

As a result, an exemption to the By-law is required to allow for overnight water pumping operation in order to maintain a dry site condition at all times during the construction period. 

 

The water pumping operation will take place for the duration of 2-3 weeks between May 15 and June 30. 

 

Staff from the Asset Management Department and its consultant will advise the abutting residents on Proctor Avenue at least 48 hours prior to the commencement of the water pumping operation. Staff will continue to monitor, keeping noise levels to a minimum during the entire operation. (Attachment ‘A’)
