MOU for delivery of a Watercourse Identification Signage Program in the Rouge River Watershed

 

This MOU is made as of <insert month, date, year>.

 

Memorandum of Understanding

 

Between

 

Town of Markham (Markham”)

And

Regional Municipality of York (“York”)

And

Toronto and Region Conservation Authority (“TRCA”)

 

 

WHEREAS the City of Toronto installed watercourse identification signs along major road right-of-ways in the Don watershed in 2009;

 

AND WHEREAS Markham, York and TRCA are in support of this project within the Rouge watershed in the Town of Markham and have agreed to be responsible for certain tasks;

 

THEREFORE, THE PARTIES AGREE AS FOLLOWS:

 

1.         Terms

 

a)       It is agreed that only key crossings along major municipal and regional road right-of-ways will be signed (Two signs per location, one for each direction of traffic).  Buried creeks and crossings in parks will not be signed.  This could be undertaken at a later date.

b)       Each non-regulatory sign will include the following features:  tributary name, Rouge watershed identifier, Markham logo and, York logo. 

c)       Installing watercourse identification signs within Rouge Park is outside the scope of this project, however, any existing signs within Rouge Park boundaries will remain and any existing signs outside of Rouge Park boundaries with the Rouge Park logo will be replaced with new signs using the Rouge watershed identifier.  

d)       82 signs at 41 locations will be installed in Markham.

 

2.        Responsibilities –TRCA

 

a)       TRCA will provide lists and maps of suitable locations and river names to Markham and York for review and approval.

b)       TRCA will coordinate and communicate with all stakeholders involved in the project including Markham and York, and will advise the Rouge Park Alliance of project progress. 

 

3.         Responsibilities – Single Tier and Upper Tier Municipalities

 

a)       Markham and York will approve sign locations and tributary names as proposed by the TRCA.

b)       Signs must be produced as per the design protocols and graphic standards outlined in Attachment 1.  City of Toronto’s sign shop has the capacity to produce these signs for other municipalities if required. 

c)       Markham and York will ensure proper placement and installation of all signs on their respective road right-of-ways according to their own municipal standards and guidelines.

d)       Markham and York will maintain and inventory of sign locations and undertake the annual review, inspection and replacement of all signs within their jurisdictions as part of their regular operational maintenance programs.

 

4.        Financial Details

 

a)       The estimated cost to produce 82 signs for the Rouge watershed in Markham is $10,865.  Costs will be refined as the number of locations and sign specifications are finalized.

 

5.        Financial Responsibilities

 

a)        Markham will pay for the production of all Markham signs for the Rouge watershed using the Don Watershed Regeneration Council grant at an estimated cost of $5,945.

b)        Markham and York will cover the costs of hardware and labour to install the signs in their own jurisdictions at an estimated cost of $4,920 (labour not included). 

c)        If more signs are required, Markham, York and TRCA will consider providing additional support subject to the availability of funds.

 

6.        Term of Agreement

 

The agreement shall commence on <insert month, day, year>, and continue for a period of 5 years, until <insert month, day, year> at which time a new agreement will be negotiated if parties agree.

 

7.        Termination

 

Any of the parties may terminate this agreement by providing 30 days written notice to the others.  Upon receipt of written notice, all parties shall be responsible for completion of work in progress to the date of receipt of notice of termination and for payment for work completed satisfactorily to the date of receipt of notice of termination and costs incurred to the date of termination.

 

Having read and understood the terms and conditions of this memorandum of understanding and having the authority to bind their respective organizations, the undersigned execute the agreement on behalf of their respective organizations.
