The Manager of Heritage Planning, gave a presentation respecting this matter and submitted the minutes of the Architectural Review Sub-Committee meeting held on June 10, 2003, relating thereto.
HERITAGE MARKHAM RECOMMENDS:
THAT the heritage permit application to replace the original windows on the property at 14 John Street be denied;
AND THAT the owner be requested to either return the original windows or if the originals no longer exist, have proper wood windows constructed as per the original specifications (double hung windows constructed with external wood muntin bars) according to the following time schedule:
(i) replace all south (front elevation) windows (i.e. the most visible) by October 2004; and
(ii) replace all remaining windows by June 2007;
AND THAT in future the owner is requested to obtain approval for a heritage permit application prior to undertaking any works on the exterior of the building.

INSULATION OF HERITAGE DWELLING (16.11)

Gobeil, owner of the property at 77 Main Street, appeared before Heritage Markham requesting permission to introduce new insulation at 77 Main Street, Unionville, and filed a proposal in regard thereto. This would involve removing all the existing exterior siding and could affect the profile of the associated windows, eaves, etc.
HERITAGE MARKHAM RECOMMENDS
THAT this matter be deferred to a future meeting of Heritage Markham in order to enable the property owner to explore other options and to report back thereon to Heritage Markham.

THAT Heritage Markham would prefer the restoration of the vertical cladding as this was the original cladding material of the dwelling;
THAT Heritage Markham has no objection to the temporary removal of the vertical cladding to permit the insulation of the building as long as the insulation is placed between the structural beams of the dwelling so as to not add any thickness to the dwelling;

Heritage Markham discussed the potential of saving the barns and whether there was any threat to these structures as there was no development approved in this area.
HERITAGE MARKHAM RECOMMENDS:
THAT if the owners are agreeable to enter into heritage easement agreements for the two heritage dwellings, located at 10379 and 10411 Kennedy Road Heritage Markham will not object to the removal of the barns and failing this agreement, Heritage Markham would object to the demolition.
AND THAT members of Heritage Markham undertake a site visit to these properties prior to the next meeting to be held on July 9, 2003.

23. PLAN OF SUBDIVISION – REQUEST FOR FEEDBACK
10372 WOODBINE AVENUE
PROPOSED RELOCATION OF HERITAGE BUILDING (16.11)

HERITAGE MARKHAM RECOMMENDS:
That although Heritage Markham would have preferred that the dwelling at 10372 Woodbine Avenue remain on its original site, given the proposed plans for the immediate area surrounding the property, Heritage Markham has no objection to the proposal to relocate the dwelling to another appropriately-sized lot within the development or within the nearby hamlet of Victoria Square;
THAT Heritage Markham would prefer that the front elevation of the relocated building continue to be oriented to Woodbine Avenue if possible;
THAT Heritage Markham has no objection to the concept of relocating the dwelling to the park area near the hamlet of Victoria Square;
AND THAT if the dwelling is relocated, the following should be included in the development agreement:
Heritage
1. Prior to final approval of the draft plan of subdivision or any phase thereof, the Owners shall carry out a cultural heritage resource assessment for the lands within the draft plan to ensure the assessment and identification of appropriate treatment of built heritage and archaeological resources, and further to mitigate any identified adverse impacts to significant heritage resources to the satisfaction of the Town (Commissioner of Development Services) and the Ministry of Culture. No demolition, grading, filling or any form of soil disturbances shall take place on the lands within the draft plan prior to the issuance of a letter from the Ministry of Culture to the Town indicating that all matters relating to heritage resources have been addressed in accordance with licensing and resource conservation requirements.
2. The Owner shall covenant and agree in the subdivision agreement to implement any measures recommended by the heritage resource assessment, to the satisfaction of the Town and the Ministry of Culture.
3. The owner covenants and agrees to
retain the Heritage Building, known municipally as 10372 Woodbine Avenue on an
appropriately sized lot identified as ___.
4.
The
owner covenants and agrees to protect the Heritage Buildings through the
following means:
a) to enter into a Heritage Easement Agreement for the building with the Town prior to the release of the plan of subdivision or any component of the plan for registration;
b) to permit the designation of the property under Part IV of the Ontario Heritage Act prior to the release of the plan of subdivision or any component of the plan for registration;
c) to provide a $25,000 Letter of Credit to ensure the preservation of a designated building. The letter of credit shall be retained for use by the Town and shall not be released until the construction and grading on the subject lands and adjacent lots and roads has been completed to the satisfaction of the Town (Commissioner of Development Services), the building has been connected to municipal services and the buildings meet the basic standards of occupancy as confirmed by the Building Standards Department;
d) to maintain the Heritage Building in good and sound condition at all times prior to and during the development of the property;
e) to secure and protect the Heritage Building from damage through procedures carried out according to the Town of Markham Guidelines for the Boarding of Heritage Structures; and
f) to erect a "No Trespassing" sign in a visible location on the property indicating that the Heritage House is to be preserved onsite and should not be vandalised and/or scavenged, and install a 4m high fence around the perimeter of each house (snow fence is permissible) to protect the dwellings until the completion of construction in the vicinity or the commencement of long-term occupancy of the dwelling as confirmed by Town (Heritage Section) staff.
5.
The
owner covenants and agrees to preserve the Heritage Building through the
following means:
a) to enter into a site plan agreement with the Town for the Heritage Building, containing details on the site plan such as driveway, grading, connections to municipal services, trees to be preserved and detailed elevations outlining the proposed restoration and any additions and alterations to be carried out on the dwelling prior to the release of the plan of subdivision or any component of the plan for registration. Details of the proposed garage or any other outbuilding, including elevations, are also to be provided;
b) to provide and implement a traditional restoration plan for the Heritage Buildings that would be reviewed and approved by the Town (Heritage Section). The restoration plan is to be included in the site plan agreement for each property;
c) to complete the exterior restoration of the Heritage House, connect all municipal services to the allocated lot (water, gas, hydro, cable, telephone etc.) and ensure basic standards of occupancy as confirmed by Building Standards Department within one year of registration of the plan of subdivision; and
d) to ensure that the architectural design and elevations of dwellings proposed for adjacent lots is compatible with the restored heritage dwelling.
6.
The
owner covenants and agrees to provide notice of the Heritage Building through
the following means:
· to provide and install at its cost, an interpretative baked enamel plaque for the Heritage Building, in a publicly visible location on the property. The plaque is to be designed according to the specifications of the "Markham Remembered" program, and outline the history of the house. Details of the design and location of the plaque are to be submitted for review and approval of the Town (Heritage Section); and
· to include the following notice in each Offer of Purchase and Sale for the Heritage Buildings on Lots --:
"PURCHASERS ARE ADVISED THAT THE EXISTING BUILDING ON THIS PROPERTY IS DESIGNATED PURSUANT TO THE ONTARIO HERITAGE ACT AND IS SUBJECT TO A HERITAGE EASEMENT AGREEMENT WITH THE TOWN OF MARKHAM. ANY PROPOSED ADDITIONS OR ALTERATIONS TO THE EXTERIOR OF THE EXISTING BUILDING SHALL BE SUBJECT TO REVIEW AND APPROVAL OF PLANS BY THE TOWN."

24. REQUEST FOR RELOCATION TO MARKHAM HERITAGE ESTATES

Mr. and Mrs. Fred Watt appeared before Heritage Markham requesting permission to relocate The Miller-Brown House, 9442 Highway 48, to the Markham Heritage Estates. Mr. Watt indicated that the dwelling would not be compatible with future development in the area.
Staff indicated that Heritage Markham Architectural Review Sub-Committee has recently recommended that there be a moratorium on public initiated requests to relocate homes to the Markham Heritage Estates Subdivision pending the completion of a study of potential heritage resources which could be relocated to the Markham Heritage Estates in the future. By completing such a study, it would help ensure that the remaining 16 lots in the heritage subdivision are reserved for the most significant of the threatened houses.
Since the subject house is under no immediate threat of removal it was recommended by staff that this proposal be received and tabled until such time as the study is completed.
HERITAGE MARKHAM RECOMMENDS:
THAT Heritage Markham does not support the relocation of The Miller-Brown House, 9442 Highway 48, to the Markham Heritage Estates
