RECOMMENDATION:

That the staff report dated April 20, 2004 entitled “Cornell Rouge Development Corporation/Jennora Inc., Conveyance of Stormwater Management Block, North Side of Highway 407, West of Reesor Road” be received;

 

And that a by-law be enacted authorizing the Mayor and Clerk to execute a development agreement in a form satisfactory to the Town Solicitor with Cornell Rouge Development Corporation for the developer to construct stormwater management facilities on the lands denoted on Figure 4 of the staff report; 

 

And that, subject to execution of the development agreement, a by-law be enacted authorizing the Mayor and Clerk to execute a Transfer/Deed of Land, in a form satisfactory to the Town Solicitor; for the lands denoted on Figure 4 of the staff report from Jennora Inc. to the Town of Markham for consideration of a nominal fee;

 

And further that the Owner of the lands adjoining the stormwater management facility be permitted the right to construct a future road crossing over the stormwater management parcel to be conveyed to the Town, subject to the necessary design and environmental approvals by the Town and the TRCA.

 

PURPOSE:

The purpose of this report is to request Council’s authorization for conveyance to the Town, prior to the execution of a subdivision agreement for the benefiting lands, of a stormwater management pond block and associated stormwater channel block, and for the Town to enter into an agreement with the developer to secure the construction of the stormwater works.

 

BACKGROUND/COMMENT:

On July 8, 2003, Council granted draft approval for plan of subdivision 19TM-030006 (Cornell Rouge Development Corporation/Madison Homes). This 432 unit subdivision is located on the south side of 16th Avenue, east of the existing Markham By-pass.   The stormwater management pond serving the east part of Cornell, including this subdivision, will be located on the north side of Highway 407 west of Reesor Road on lands currently owned by Jennora Inc.and proposed to be conveyed to the Town. 

 

Cornell Rouge Development Corporation and Jennora Inc. have entered into an agreement whereby Jennora Inc. will transfer the subject lands required for the stormwater management pond and associated channel to the Town.  Cornell Rouge Development Corporation is to enter into a development agreement with the Town and will construct the facility. 

 

The lands occupied by stormwater management facilities are usually conveyed to the Town and stormwater works secured through the subdivision agreement for the benefiting lands.  In this instance, a separate development agreement to be authorized by Council is required because the lands will be conveyed to the Town and the stormwater works constructed prior to the execution of the subdivision agreement.

 

The East Markham Strategic Review identified the lands south of Highway 7 between Reesor Road and the future Markham By-pass as potential future employment lands.  Development of these lands for employment purposes would likely necessitate a road crossing over the channel to interconnect the employment lands.  Jennora Inc. has requested that the Town commit to permit Jennora the right to construct a future road crossing over the stormwater management lands being conveyed to the Town. This is a reasonable request and is addressed in the recommendation.  The intent is that Jennora construct the road at their cost, with no compensation to the Town for crossing the stormwater management lands, and subject to the necessary design and environmental approvals by the Town and TRCA.

 

ENVIRONMENTAL CONSIDERATIONS:

The location and design of the proposed stormwater management facility are consistent with the approved Stormwater and Environmental Management Strategy Report and Master Drainage Plan for the Cornell community.   The configuration of the pond block and the alignment of the channel have been refined in consultation with the T.R.C.A to maximize terrestrial habitat potential and to minimize the exposure of the facility to salt spray and other negative impacts of nearby roads.  The TRCA is currently reviewing detailed design plans for the facility.  There is no significant vegetation on the subject lands. 

 

FINANCIAL CONSIDERATIONS:

Nominal consideration.

 

 

BUSINESS UNITS CONSULTED AND AFFECTED:

The proposed block configurations and pond design have been reviewed by the Planning/Design and Engineering Departments.
