RECOMMENDATION
THAT a by-law be enacted authorizing the Mayor and Clerk to execute the
conveyance of a permanent easement to Rogers Cable in a form satisfactory to
the Town Solicitor over a portion of Town owned land located on part of Lot 17,
Concession 7, and described as Part 1 Plan 65R-26978 subject to:
a) The payment of
$750.00 plus applicable taxes representing the market value of the easement.
b) The payment of
$1,500.00 in total for Engineering and Legal expenses plus disbursements.
PURPOSE
To obtain authorization from Council to convey an easement to Rogers
Cable for the placement and maintenance of a communications pedestal and vault
as shown on Figure 2 attached hereto.
BACKGROUND
The Wynberry Development Phase 1 draft plan is located north of
In general, the roadways within the draft plans are designed to
accommodate the above ground and below ground utility plants required to
service the development. More recently, with the demand for more high
speed telecommunications technology to the home, some of the above ground
utility infrastructure has become larger in size. These larger units may
not fit into the standard road allowance space normally reserved for utilities
or would be aesthetically too large to place in front of a dwelling unit. In
these cases it may be necessary to locate outside the typical right-of-way on
land owned by the Town or developer. Development staff and the utility
companies have established a review process that attempts to identify utility
easement blocks when required before the finalization of the draft plan.
This process will reduce the need to seek separate approval from Council.
However, due to timing, changing technology, the stage of the detailed utility
designs and the phasing of the development there will be times when the utility
easement blocks cannot all be identified upfront. In these cases, the
utility company will need to apply separately to obtain the necessary easement
from Council.
Town staff has been working with Rogers Cable to find a suitable
location for the installation of this required vault and pedestal in the
Wynberry development.
OPTIONS/DISCUSSION
Rogers Cable has submitted a request to the Town for the conveyance of a

FINANCIAL CONSIDERATIONS
As the
easement is on the land owned by the Town, it is recommended that the easement
be conveyed to Rogers Cable for consideration of $ 750.00 plus applicable taxes
being the market value of the easement. Furthermore, Roger Cables must remit to
the Town $ 500.00 plus disbursements for Legal fees and $ 1,000.00 for
Engineering fees to process the easement application.
BUSINESS UNITS CONSULTED AND AFFECTED
The Planning, Urban Design and Legal Departments have been consulted in
establishing the easement location and in the preparation of this report.
