PRELIMINARY REPORT

Applications by Wismer Markham Development Inc.,

For Zoning By-law Amendment at 9442 and 9506, Hwy 48

 

 

ZA 03-113694, ZA 04-024270


 

RECOMMENDATION:

That a Public Meeting be held to consider zoning amendment applications ZA 03-113694 and ZA 04 024270 submitted by Wismer Markham Development Inc for the rezoning of 9442 and 9506 Highway 48 from Rural Residential (RR4 and RR2) to Major Commercial Area in By-law 177-96;

And That the applications be referred back to staff for a report and recommendation following the Public Meeting. 

 

PURPOSE:

The purpose of this report is to provide preliminary information regarding applications to rezone 9442 and 9506 Highway 48 for major commercial use, and to recommend that Committee authorize the scheduling of a public meeting.

 

BACKGROUND:

Property and Area Context

The subject properties (9442 and 9506 Highway 48) are located on the west side of Highway 48 north of the Markham Museum and have areas of 981 m2 (0.24 acres) and 8377 m2 (2.07 acres) respectively.  9442 Highway 48 is vacant. 9506 Highway 48 is occupied by an existing dwelling which is listed in the Markham Inventory of Heritage Buildings.  

 

To the north, south and west of 9442 Highway 48 are vacant lands owned by Wynberry Developments which are currently zoned for major commercial uses.  

 

To the north and west of 9506 Highway 48 are vacant lands owned by Matrundola Construction.  To the south are lands owned by Wynberry Developments, all of which are currently zoned for major commercial uses.

  

To the east, across Highway 48 are existing mixed and industrial uses most of which were constructed between 1965 and 1975.

 

Official Plan and Zoning By-law

The subject properties are designated “Major Commercial Area” in the Official Plan.  They are currently zoned Rural Residential (RR4 and RR2) by By-law 304-87, as amended (see Figure 2).

 

Proposal:

Rezoning the Major Commercial requested

The applicant is requesting rezoning of the subject properties to the “Major Commercial” (MJC) under By-law 177-96. This zoning currently applies to the lands adjoining the subject properties. It is anticipated that the subject properties will ultimately be integrated into the adjoining larger commercial blocks, facilitating comprehensive site development

 

POTENTIAL BENEFITS OF APPROVAL OF THE PROPOSAL:

The requested rezoning would help to facilitate comprehensive site development of the major commercial lands in the vicinity.  

 

CONCERNS/ISSUES TO BE RESOLVED:

On October 12, 2004, Council authorized staff to retain consultants to undertake retail impact and urban design studies for the portion of Highway 48 between 16th Avenue and Major Mackenzie Drive.  These studies will have a potential bearing on the future development of the subject properties.  While these applications can proceed to a public meeting, the staff recommendation report and the implementing zoning will need to have regard for the studies underway.

 

FINANCIAL CONSIDERATIONS:

No financial implications are to be considered in this report.

 

BUSINESS UNITS CONSULTED AND AFFECTED:

The requested rezoning applications are currently in circulation to other Town Departments and agencies for review and comments.

 

CONCLUSION:

It is recommended that the Committee authorize the scheduling of a Public Meeting to consider the requested zoning amendments.
