DATE OF MEETING:

2004-Nov-09

SUBJECT:

Data Use Licence Agreement with the Province of Ontario

RECOMMENDATION:

That Council authorize the Town Solicitor to finalize a data use licence agreement with the Province of Ontario to the Town Solicitor’s satisfaction.

And that Council authorize the Mayor and Clerk to enter into a data use licence agreement with the Province of Ontario to provide them with Town digital mapping for the Places to Grow Growth Plan for the Greater Golden Horseshoe.

PURPOSE:

This report identifies the requirement for the Town to enter into a data use licence agreement with the Province of Ontario in order to provide them with digital mapping to be used to assist in preparing the Places to Grow Growth Plan for the Greater Golden Horseshoe.

BACKGROUND:

The Ministry of Public Infrastructure Renewal has requested on behalf of the Province digital mapping from the Town that will include the Town’s parks dataset and mapping components that comprise Schedule ‘A’ to the Official Plan. The mapping data is to be used in connection with preparing the Places to Grow Growth Plan for the Greater Golden Horseshoe and more particularly to develop maps that show municipal land-use boundaries for plans and studies that involve growth and growth planning.

The Town has expressed support for Provincial growth management initiatives and is in a position to assist the Province. In order to provide this data to the Province, the Town requires a data use licence agreement with the Province.

OPTIONS/DISCUSSION:

In order to facilitate the Provincial request the Town requires a data use licence agreement with the Province. A draft agreement has been prepared by the Town Solicitor and reviewed by the Chief Information Officer. It is recommended that the Town Solicitor be authorized to finalize the agreement and that Council authorize the Mayor and Clerk to enter into the data use licence agreement.

FINANCIAL CONSIDERATIONS:

There are no financial considerations for the Town. The Town retains ownership of all licenced digital mapping.

BUSINESS UNITS CONSULTED AND AFFECTED:

Both the Legal and Information Technology Departments were consulted with regard to the content of the agreement.

ATTACHMENTS:
