Applications for Official Plan and Zoning By-law Amendment to add a Place of Worship to the list of permitted uses

RECOMMENTDATION:

That the staff information report dated November 23, 2004 regarding the proposed Official Plan and Zoning By-law Amendments, ZA 04 026537 and OP 04 26818, for 175 Anderson Avenue, be received as information relative to the Public Meeting scheduled for November 23, 2004.

 

PURPOSE:

Public meeting authorized

On October 19, 2004, Development Services Committee passed a resolution authorizing staff to schedule a public meeting to consider the proposed place of worship.  There was no accompaning staff report at that time.  The Public Meeting is scheduled for the evening of Tuesday November 23, 2004.  

 

The purpose of this information report is to provide background information regarding applications for an Official Plan Amendment and rezoning to allow for a Place of Worship at 175 Anderson Avenue.

 

BACKGROUND:

Property and area context

The subject property has an area of 0.5 hectares (1.2 acres) and is located on the east side of Anderson Avenue, east of Highway 48.  The existing building on the property is currently occupied by an adult entertainment parlour.

 

 

 

To the immediate north is the future Castlemore Road extension into the Greensborough community.  To the east is the Go Transit Stouffville Rail Line and to the east of the rail line are lands that have been Draft Plan Approved and zoned for low density residential uses.  To the south are multi-tenant industrial buildings.  To the west across Anderson Avenue is vacant land which is zoned for industrial uses. 

 

Official plan and zoning by-law

The Official Plan designates the lands COMMERCIAL (Major Commercial Area).  This designation provides for places of worship.  However, Official Plan Amendment No. 115 (Places of Worship) only permits Places of Worship along Provincial Highways, arterial or major collector roads.  As Anderson Avenue is designated a local road, an Official Plan Amendment is required to allow for such use.

 

The lands are currently zoned Select Industrial and Warehousing (M.I.), with specific permission for an adult entertainment parlour by (By-law 88-76), as amended.  This zoning designation does not permit a place of worship and therefore a zoning amendment is required.

 

Proposal

The applicant has submitted applications to amend the Town’s Official Plan and Zoning By-law to add a “Place of Worship” to the list permitted uses at 175 Anderson Avenue. 

 

POTENTIAL BENEFITS OF APPROVAL OF THE PROPOSAL:

With the future extension of Castlemore Road into the Greensborough community, this property will be highly exposed to the residential community to the east.  Town staff consider a place of worship a more compatible use within such a close proximity to residential areas than the existing adult entertainment parlour.

 

CONCERNS/ISSUES TO BE RESOLVED:

The following is a brief summary of concerns/issues raised to date.

 

Further information is required to determine the parking requirement for the subject property.  A detailed floor layout will determine whether there is sufficient parking on site to support the proposed use.   

 

FINANCIAL CONSIDERATIONS:

There are financial implications to be considered in this report.

 

ENVIRONMENTAL CONSIDERATIONS:

There are environmental implications to be considered in this report.

 

ACCESSIBILITY CONSIDERATIONS:

Parking spaces for disabled persons will be provided in appropriate locations with curb depressions and ramps.

 

 

 

 

 

 

BUSINESS UNITS CONSULTED AND AFFECTED:
