DESIGNATION UNDER PART IV OF

THE ONTARIO HERITAGE ACT

James Darius Harrington House

9642 Ninth Line

RECOMMENDATION:

THAT the “James Darius Harrington House” at 9642 Ninth Line be approved for designation under Part IV of the Ontario Heritage Act, as recommended by Heritage Markham

 

AND THAT  the Clerk’s Department be authorized to:

 

*  publish and serve Council’s Notice of Intention to Designate as per the requirements of the

    Act; and

 

*  prepare the Designation By-law for the property.

 

PURPOSE:

To recommend to Council that the “James Darius Harrington House” (historical reference) at 9642 Ninth Line be designated under Part IV of the Ontario Heritage Act for its cultural heritage value and interest.

 

BACKGROUND:

The James Darius Harrington House is a significant heritage resource listed on the Markham Inventory of Heritage Buildings and identified in the Greensborough Secondary Plan. It is a rare example of a vernacular building where the identity of the builder and an exact year of construction are known.  According to the records of the Harrington Planing Mill in Unionville, the house was constructed for James D. Harrington in 1874. A detailed research report is attached as Appendix ‘A.’

 

The Subdivision Agreement requires the preservation of the building

 

This building is owned by Humbold Properties Ltd. and is located in the Greensborough Community Phase 2. According to the Secondary Plan, the parcel is designated “Community Amenity Area.” When the Markham By-pass is constructed through this area, the house will be on an island separate from Phase 2 of the Humbold Properties Ltd. – Greensborough subdivision by the By-pass and the re-aligned Ninth Line.

 

The preservation and heritage designation of the James D. Harrington House is included under Section 6.20 of the Subdivision Agreement for this phase of the Humbold Properties Ltd. lands.  The Subdivision also provides for the owner to enter into a Heritage Easement agreement.

 

Heritage Markham supports the designation of the property

 

The house, currently vacant and boarded, has been evaluated as a Group 2 heritage building. In August, 2002 Heritage Markham passed a resolution recommending that 9642 Ninth Line be retained on site, or incorporated into a heritage area within the surrounding subdivision.  This was in response to a request to consider the house for relocation to Markham Heritage Estates, which was not supported by Heritage Section Staff or Heritage Markham. 

 

As part of the comprehensive heritage preservation program for the Greensborough Community, Heritage Markham recommended that the property be designated under Part IV of the Ontario Heritage Act at its meeting of October 13, 2004 (See Heritage Markham Extract, Appendix ‘B’ ).

 

OPTIONS/DISCUSSION:

The designation of the James Darius Harrington House will give it protected status to assist with its preservation within the context of the Greensborough development.  At present, the building is vacant and secured by the boarding of openings.

 

With Phase 1 of the Humbold/Madison Homes subdivision nearing completion, the option to move the subject house next to the existing designated heritage building at 8 Green Hollow Court (Clendenen House, formerly 9516 Ninth Line) is no longer possible.  Based on Heritage Markham’s 2002 recommendation, 9642 Ninth Line should be retained on its original site on its existing foundation as the first priority, or as a second option, be relocated to an appropriate site within the context of a future development on the same parcel.

 

Should Council decide to proceed with the recommendation to designate 9642 Ninth Line under Part IV of the Ontario Heritage Act, the Clerk’s Department should be authorized to:

 

*  publish and serve on the property owner, the Ontario Heritage Foundation and the public

    through a newspaper advertisement, Council’s notice of intention to designate the property

    as per the requirements of the Act, and

 

*  prepare the designation by-law for the property.

 

ENGAGE 21ST CONSIDERATIONS:

Heritage designation helps to achieve a quality community by recognizing, promoting and protecting a heritage resource, which strengthens the sense of community.

 

BUSINESS UNITS CONSULTED AND AFFECTED:

Acceptance of this recommendation to designate 9642 Ninth Line will require the Clerk’s Department to initiate the notice process and prepare the designation by-law.
