DESIGNATION UNDER PART IV OF THE ONTARIO HERITAGE ACT

RECOMMENDATION:

THAT pursuant to the Conservation Review Board recommendation dated September 22, 2004, Council pass the attached by-law (Appendix ‘C’) designating the Menno Raymer House at 9404 Highway 48 under Part IV of the Ontario Heritage Act.

 

PURPOSE:

The purpose of this report is to advise Council of the Conservation Review Board’s findings and recommendations with respect to the Town of Markham’s intention to designate the Menno Raymer House at 9404 Highway 48 as a property of cultural heritage value and interest under Part IV of the Ontario Heritage Act.

 

BACKGROUND:

Council recommended the subject property for heritage designation

On September 30, 2003, based on the recommendation of Heritage Markham, Council passed an Intention to Designate 9404 Highway 48 as a property of cultural heritage value and interest under Part IV of the Ontario Heritage Act.  The owner filed an objection to the Intention to Designate, which resulted in Council at its meeting of November 25, 2003, referring this matter to the Conservation Review Board for a hearing, in accordance with the legislation.  

 

The Owner filed an objection to the Intention to Designate, triggering the need to hold a hearing before the Conservation Review Board

Pursuant to Section 29(8) of the Ontario Heritage Act, R.S.O. 1990, Chapter 0.18 (as amended), the Conservation Review Board held a hearing in the Town of Markham on September 22, 2004, concerning Council’s Intention to Designate 9404 Highway 48, The Menno Raymer House, under Part IV of the Act.

 

The Conservation Review Board recommendation upholds the Town’s position

In a report dated September 22, 2004, the Conservation Review Board recommends that Council designate 9404 Highway 48 under the Ontario Heritage Act. A copy of the report is attached as Appendix ‘A.’

 

Heritage Markham supports the recommendation of the Conservation Review Board

Heritage Markham received the report of the Conservation Review Board at the November 10, 2004 meeting and passed the following recommendation:

THAT Heritage Markham recommends to Council that the findings of the Conservation Review Board with respect to 9404 Highway 48 be accepted, and a by-law be passed to designate the property under the Ontario Heritage Act. (See Heritage Markham Extract, Appendix ‘B’).

 

OPTIONS/DISCUSSION:

The recommendation of the Conservation Review Board upholds the Town of Markham’s position that the subject property is worthy of protection and designation under the Ontario Heritage Act.  It is therefore recommended that the designation process now be completed through Council passing the attached by-law (Appendix ‘C’) to designate 9404 Highway 48 under Part IV of the Ontario Heritage Act.

Heritage designation helps to achieve a quality community by recognizing, promoting and protecting a heritage resource, which strengthens the sense of community.

 

BUSINESS UNITS CONSULTED AND AFFECTED:

Acceptance of this recommendation to pass the by-law designating 9404 Highway 48 under Part IV of the Ontario Heritage Act will require the Clerk’s Department to complete the designation process and initiate the registration of the designation by-law on the property title.
