RECOMMENDATION:

That the widened sections of Chippenham Lane (“transformer blocks”) as described in Schedule “A” be declared surplus as required by By-law 178-96, and that notice of the disposition of  described lands be placed on the agenda for the Council meeting of May 24th , 2005;

 

And that a by-law be enacted on the Council meeting dated June 14th, 2005 to stop up and close the transformer blocks as described in Schedule “A”;

 

And that approval be granted to the Manager of Real Property to exchange the lands described in Schedule “A” with Wykland Estates Inc. for a nominal fee;

 

And the Mayor and Clerk be authorized to execute all related documents necessary to give effect to this recommendation in a form satisfactory to the Town Solicitor for the exchange of lands with Wykland Estates Inc. as described in Schedule “A”;

 

And that a by-law be enacted to dedicate the new transformer blocks along Chippenham Lane as public highway.

 

AND FURTHER THAT Wykland Estates Inc. compensate the term for all municipal processing costs incurred to implement the above.

 

 

PURPOSE:

The purpose of this report is to deal with a request by Mattamy Homes to re-locate three hydro transformers in their subdivision in the Cornell community. This relocation will require the exchange of blocks of land within the public right-of-way currently owned by the Town for new blocks of land where these transformers are to be relocated to.   

 

OPTIONS/DISCUSSION:

 

In the Cornell community, the underground hydro lines serving the homes are located in the rear lanes. The required hydro transformers are located in widened sections of the lane right-of-way known as “transformer blocks.” When the hydro service was installed in the Wykland Estates (Mattamy Homes) subdivision in Cornell (Plan 65M-3767), three transformers were inadvertently installed by Mattamy in locations where the lane had been widened to accommodate the transformer without advising the prospective purchases. To address this problem, Mattamy Homes has requested the Town to incorporate four new “transformer blocks” into the rights-of-way of the adjoining lanes, and to convey the five unused “transformer blocks” back to Mattamy to be incorporated into the adjoining residential lots. Staff from the Engineering and Legal Departments have reviewed Mattamy’s request and have no objection subject to recovery of all costs incurred by the Town to undertake these transfers. 

 

FINANCIAL CONSIDERATIONS:

Mattamy has agreed to pay the Town all municipal processing costs incurred to affect this change. 

 

BUSINESS UNITS CONSULTED AND AFFECTED:

The Legal Department has reviewed this report and their requirements have been incorporated in this report.
