RECOMMENDATION:

That Council approve the conveyance to the Town of Markham of land adjacent to the northwest corner of the Larkin-Monarch Partnership draft plan, being described as Part 1 and Part 2 on a Draft Reference Plan prepared by David Horwood Limited, dated January 28, 2005 (to be deposited), from Donna Marie Beckett, Ewart Ross Beckett and Lawrence Frank Beckett, containing an area of approximately 0.105 hectares (0.26 ac), for road dedication and parkland purposes, for nominal consideration and free and clear of all encumbrances, with all costs associated with the conveyance including the design and construction of the road extension over the subject lands, as set out in the subdivision agreement, be borne by the developer of the abutting plan of subdivision;

 

And that the Mayor and Clerk be authorized to execute all related documents necessary to give effect to this recommendation, in a form satisfactory to the Town Solicitor, for the acquisition of approximately 0.105 hectares (0.26 ac) of land, adjacent to the northwest corner of Larkin-Monarch Partnership draft plan, being described as Parts 1 and 2 on a Draft Reference Plan prepared by David Horwood Limited, dated January 28, 2005 (to be deposited).

 

PURPOSE:

The purpose of this report is to provide information regarding conveyance of a 0.105 hectare (0.26 ac) parcel of land to the Town of Markham from the Beckett family, for road and parkland dedication purposes.  This parcel of land is adjacent to the northwest corner of the Larkin-Monarch Partnership draft plan and is necessary to complete The Bridal Walk. Once complete The Bridle Walk will be the only north/south collector extending from Major Mackenzie Drive to 16th Avenue and will serve as a transit route.

 

 

BACKGROUND:

Larkin – Monarch plan of subdivision located north of 16th, west of McCowan

Draft Plan 19T-95009 comprises 70.68 hectares (174.67 ac.) and is located in the southeast portion of Berczy Village.  It was draft approved by the Town on March 6, 1997.  The plan was draft approved in blocks. The draft plan has been implemented in phases, with M-plans dividing the blocks into lots, along with concurrent zoning by-law amendments.  Phases 5A and 5B, are the final phases within this draft plan and are 9.85 hectares (24.3 ac) and 6.33 hectares (15.64 ac) respectively.

The property is surrounded by a number of uses

Agricultural uses (Beckett farm) and the Unionville Alliance Church adjoin the property to the west, a community park to the north, and open space and low density residential to the east and south (Figure 2).

 

Phases 1-4 are registered and comprise a mix of detached and townhouse units

The previous phases of Draft Plan 19T-95009 are registered and include a mix of detached and townhouse units. Staff is processing Phase 5A for registration.

 

PROPOSAL:

In January 2004, by-law amendments 2004-313 and 2004-314 were enacted by Council to implement the Larkin – Monarch Partnership draft plan of subdivision (Phase 5A and 5B) for 186 single detached units. Staff is presently processing the subdivision agreement.  Through the approval process, staff requested that the Larkin – Monarch Partnership purchase a 0.105 hectare (0.26 ac.) parcel outside the boundaries of their plan of subdivision to complete The Bridle Walk.  The lands are presently under the ownership of the landowner to the west (Becketts) (Figure 2). Through negotiation with Larkin-Monarch Partnership and the Town, the Beckett land owners have agreed to convey the lands to the Town to complete The Bridle Walk and the community park located at the northeast corner of Wilfred Murison Avenue and The Bridle Walk. The Larkin-Monarch Partnership has agreed in their subdivision agreement to pay for the design and construction of the road.  The developer has also agreed to bear all costs associated with the conveyance.

 

Part 1 is 0.093 hectares (0.23 ac) and will connect the northern section of the Bridle Walk to the southern section and will be dedicated as a public road.  The 0.012 hectare (0.03 ac) remnant parcel (Part 2) will be combined to complete the adjacent park. 

 

POTENTIAL BENEFITS OF APPROVAL OF THE PROPOSAL:

Some of the anticipated benefits of the proposal include:

 

·        Once complete The Bridle Walk will be the only north/south collector through Berczy extending from Major Mackenzie Drive to 16th Avenue.

·        The Bridle Walk will serve as a transit route.

·        The community park located at the northeast corner of The Bridle Walk and Wilfred Murison Avenue will be completed.

 

FINANCIAL CONSIDERATIONS:

The Larkin-Monarch Partnership has agreed in their subdivision agreement to pay for the design and construction of the road.  The developer has also agreed to bear all costs associated with the conveyance.

 

BUSINESS UNITS CONSULTED AND AFFECTED:
