A by-law to amend By-law 165-80, as amended by By-law 28-97, as amended

THE COUNCIL OF THE CORPORATION OF THE TOWN OF MARKHAM HEREBY ENACTS AS FOLLOWS:

 

1.   By-law 165-80, as amended, is hereby further amended as follows:

 

 

1.1      By adding to Section 7 – Exceptions the following new subsection:

 

 

“7.101              Notwithstanding any other provision of this By-law, the provisions in this Section shall apply to Part of Lot 10 Concession 4, and Part of Road Allowance between Lots 10 and 11 Concession 4, municipally know as 8500 Warden Avenue, as shown on Schedule ‘A’ attached to By-law 2005-xx.  All other provisions of this By-law, unless specifically modified/amended by this section, continue to apply to the lands subject to this section.

 

7.101.1               Special Parking Provisions

 

The following parking provisions apply:

 

a)               A charge, fee or payment for the use of any parking space is allowed”

 

 

2.         All other provisions of By-law 165-80 as amended not inconsistent with the provisions of this by-law shall continue to apply.

LANDS AFFECTED

This By-law amendment applies to approximately 3.84 ha. (9.5 acres) of land located on the south side of Highway 7, west of Warden Avenue, and municipally known as 8500 Warden Avenue.

 

EXISTING ZONING

The property is zoned Select Industrial with Limited Commercial (M.C. 90%) pursuant to By-law 165-80.  The application is to amend By-law 165-80 as amended by By-law 28-97 (Parking By-law) to permit paid parking in conjunction with the hotel operations.  The Applicability provisions of By-law 28-97 (Section 8.1) specify that no charge, fee or payment shall be required for the use of any parking space required by the by-law except for commercial parking lots, parking lots owned or operated by a public authority, or hospitals.

 

PURPOSE

To amend By-law 165-80 as amended by By-law 28-97 (Parking By-law) to permit paid parking in conjunction with the hotel operations. 

 

EFFECT OF THIS BY-LAW

The effect of this by-law is to exempt this site from the Applicability provisions contained in Section 8.1 CHARGES OR FEES of By-law 28-97 to permit the introduction of paid parking in conjunction with the hotel operations.
