The Development Services Committee convened at the hour of 1:00 p.m. in the Council Chambers with Councillor G. McKelvey in the Chair. Councillor G. McKelvey left the meeting at 3:50 p.m., at which time Councillor D. Horchik assumed the Chair.

1.         KING DAVID DEVELOPMENTS LIMITED
10372 WOODBINE AVENUE DRAFT PLAN OF SUBDIVISION AND
REZONING (SU 01101288, ZA 01110312), CATHEDRAL COMMUNITY

The Committee had before it the report dated September 18, 2001, from the Development Services Commission regarding Draft Plan of Subdivision and rezoning applications (SU 01101288 and ZA 01110312) by King David Developments Limited for 10372 Woodbine Avenue; and the following correspondence:


 

- P. May, York Region Transportation and Works Department, dated September 7, 2001 regarding a review of the Transportation Study from Cole Sherman;

- Michael Gagnon of Gagnon Law Bozzo, Planning Consultants for 1212763 Ontario Ltd. (Azuria): dated April 26, 2001, regarding Community Meeting;

             : dated July 19, 2001, regarding concerns;

- Speros Zaharopoulos, July 10, 2001, regarding the proposed Woodbine Bypass;

- Dr. C.T. (Gus) Zachos ,July 12, 2001, regarding the proposed Woodbine Avenue Bypass;

- James Kennedy of KLM Planning Partners Inc., September 18, 2001, regarding concerns

on behalf of the Tucciarone Family and Roamin Stables.

 

James Kennedy of KLM Planning Partners Inc., representing the Tucciarone Family and Roamin Stables, advised that his clients had recently filed development applications for their properties. He stated they are pleased to see the King David proposal proceed, subject to the issues outlined in Mr. Kennedy's letter dated September 18, 2001.

 

Bob Forhan of Forhan Rogers, planning consultants for King David Developments, advised he does not support the staff recommendations with respect to the Regional requirements for the Woodbine By-pass, as he considers that it is irrelevant to the King David application. He requested the draft plan approval be granted at this time. Mr. Forhan also advised King David Development has acquired an additional 200 acre parcel to the south, and will be filing development applications for that land. He stated that discussions with the Church and other landowners have been taking place, and cooperating efforts will continue.

 

Jim Kirk, of Malone Given Parsons Ltd., representing Reverend John S. Pazak and the Eparchy for the Cathedral of the Transfiguration, expressed concern for parking, the proposed density surrounding the Cathedral, and effects on the views, vista, and pedestrian traffic. He requested their interests be kept in mind during the process.

 

Helen Bucic, 563 Deloraine Avenue, Toronto, M5M 2C5, representing the Eparchy and Cathedral congregation, expressed concern for parking, and potential obstruction of the Cathedral.

 

Michael Melling, of Davis Howe Partners, representing the Azuria landowners, expressed concerns regarding the Woodbine Avenue by-pass issue, and supported a deferral of this matter to enable further discussions.

 

A representative of Mr. E.J. Elward, an area landowner, indicated that cooperative negotiations with King David Developments are on-going.

 

Dr. Gus Zachos, 42 Kensington Drive, Richmond Hill L4E 3S7, representing Speros Zaharopoulos, owner of  11087 Woodbine Avenue, stated their concern for the effect of  re-location of Woodbine Avenue, on their commercial property. Staff were directed to keep Mr. Zachos informed.


 

Committee reviewed ownership of lands and the required authorization for applications.

Committee also discussed the requirements of York Region with respect to the Transportation Study prepared by Cole-Sherman. It was suggested Cole-Sherman may be retained to complete the study to meet the Region's requirements, however, clarification of the Region's position is required. Staff explained the issue this day is the Woodbine Avenue by-pass, and reviewed the process involved. A report on the application for Draft Plan approval is anticipated to be presented to the Development Services Committee in November, 2001.

 

Committee directed that clarification of York Region's requirements be provided to Council at its meeting scheduled for September 25, 2001.

 

RECOMMENDATION:

 

That the following recommendation be deferred to the Council meeting scheduled for September 25, 2001, to enable Town staff to clarify York Region's position and requirements:

 

*          That the Director of Engineering be authorized to retain a traffic consultant to prepare a needs and justification report for the proposed Woodbine By-pass as required by the Region of York;

And that such report be funded from account # 08353993772005, to an upset limit of $20,000 + GST/disbursements, to be included in a future area specific Development Charges By-law for the Cathedral Community Secondary Plan area;

And that an amendment to the Cathedral Community Secondary Plan to give effect to Council’s July 10, 2001 endorsement of the proposed by-pass, be processed concurrently with these applications;

And that a Public Meeting be held to receive input from area land owners and residents on such an amendment to the Cathedral Community Secondary Plan.

*          Amended by Council at its meeting held on September 25, 2001 to read as follows:

 

That the Town of Markham supports the Region of York proposal to amend the map schedules to the Regional Official Plan to indicate the proposed Woodbine Avenue By-pass (around the Hamlet of Victoria Square);

 

And that the Town of Markham supports the Region of York proposal to hire a Transportation Consultant to address specific issues of alignment, intersection spacing, design criteria and traffic impacts relating to the proposed Woodbine Avenue By-pass;


 

And that the terms of reference to be developed by the Region ensure that the requirements of the Environmental Assessment Act will be met through the Transportation Study and the subdivision approval process relating to the proposed Woodbine Avenue By-pass;

 

And that the Town of Markham cost share in the Transportation Study to an upset limit (Markham share) of $20,000.00 plus GST  (Account # 08353993772005), to be recouped in a future area specific Development Charges By-law for the Cathedral Community Secondary Plan area;

 

And that the Town of Markham supports an amendment to the Regional Development Charges By-law to include provision for the proposed Woodbine Avenue By-pass.

 

And further that the proposed plan of subdivision in the Cathedral Community by King David Developments Limited be brought forward for draft approval by the Town of Markham on a priority basis, concurrent with the adoption by the Region of the proposed Regional Official Plan Amendment relating to the Woodbine Avenue By-pass provided the final conditions of draft approval reflect the outcome of the Transportation Study noted above be deferred and referred to the Unionville Subcommittee.

 

 

2.         CHIAVATTI, KAKALTERIS, PARASKEVAKOS, PANACI, GARRITANO,
102, 132, 156, 162, 186 AND PORTIONS OF 138 HELEN AVENUE
PLAN OF SUBDIVISION AND ZONING BY-LAW, (SU.99-027062, ZA.99-027002)
(10.7, 10.5)

 

Councillor Virgilio disclosed an interest with respect to the proposed Plan of Subdivision and rezoning by Chiavatti, Kakalteris, Paraskevakos, Panaci, and Garritano for 102, 132, 156, 162, and portions of 138 Helen Avenue, by nature of having represented Garritano, one of the owners, and did not take part in the consideration or discussion of or vote on the question of the approval of such matter.

 

RECOMMENDATION:

 

*  That draft plan of subdivision 19TM-99021 (SU.99-027062) proposed by Chiavatti, Kakalteris, Paraskevakos, Panaci and Garritano for lands located east of Kennedy Road and north of Helen Avenue, be draft approved subject to the conditions outlined in Appendix ‘A’.

That the zoning application (ZA.99-027002) to amend By-laws 304-87, as amended, and By-law 177-96, as amended, submitted by Chiavatti et. al., be approved and the implementing  Zoning By-laws attached as Appendix ‘B’, be enacted;

That water supply allocation for up to 87 units in the draft plan of subdivision be granted;


 

That the Town reserve the right to revoke or reallocate sewage and water supply allocation should the development not proceed in a timely manner; and

That York Region be advised of the sewage and water supply allocation for this development.

3.         YORK REGION DISTRICT SCHOOL BOARD
UNIONVILLE HIGH SCHOOL, SITE PLAN APPROVAL FOR
ALTERATIONS & ADDITIONS (SC.00-246384)(10.6)

 

The Committee had before it the report dated September 18, 2001, from the Development Services Commission regarding an application by York Region District School Board for Site Plan approval at Unionville High School.

 

Committee discussed parking congestion concerns. Maureen O’Shaughnessy, of Carruthers, Shaw and Partners Architects, representing York Region District School Board, advised that parking alternatives will be provided, and that the Board is anxious to proceed.

 

RECOMMENDATION:

That the Development Services Commission Report entitled “York Region District School Board - Unionville High School - Application for Site Plan Approval  (SC.00-246384) to Permit Alterations and Additions”, be received;

And that the Town of Markham coordinate with the York Region District School Board and the Region of York potential cost-sharing, approvals and implementation of the recommended school access to Warden Avenue at the existing traffic signal located at Warden Avenue/Town Square Plaza;

And that the York Region District School Board/Unionville High School develop and implement a Student Travel Management Plan for Unionville High School to reduce the use of cars and identify opportunities for school busing and increased public transit usage for students, in consultation with Transit Authorities;

And that the Unionville High School continue to use both the Town Centre Boulevard and Apple Creek Boulevard accesses for student pick-up and drop-off;

And that the York Region Board of Education be required to expand the parking lot at Unionville High School by 102 parking spaces for a total of 273 parking spaces;


 

And further that the site plan application be approved subject to a site plan agreement being entered into by the York Region District School Board to include the following provisions:

1.      That revisions to the site plan necessary to reflect the recommendations of this report be
         incorporated into the final plans to be approved by the Commissioner of Development
         Services or designate;

 

2.      That the site plan, grading plan and landscape plan be approved by the Commissioner of
         Development Services or designate;

3.      That provision be included for the timing, funding and construction of the driveway access
         from to the existing signalized intersection at Warden Avenue/Town Square Plaza to the
         satisfaction of the Town and the Region of York;

4.      That provision be included for continued monitoring of parking and traffic demand for a
         period of up to 5 years and arrangements for any additional traffic and/or parking
         improvements to meet requirements;

5.      That standard provisions and requirements of the Town and public agencies be included;

6.      That provision be included for the watering and maintenance of the newly planted and
         relocated trees on the property; and,

7.      That provision be included for the payment of all applicable fees and recoveries.

4.         IRISH ROSE DRIVE, SIDEWALK LOCATION (5.18)

The Committee had before it the report dated September 18, 2001 from the Development Services Commission regarding the sidewalk location on Irish Rose Drive.

 

Alan Brown, Director of Engineering, provided a coloured site plan and explained the results of the survey.

David Lougheed, 3 Irish Rose Drive, made a presentation regarding his concerns for safe access to the parkette and mailboxes, and the effect on property values. He questioned the validity of the survey, with respect to the "no sidewalk" option.

 

The Committee discussed parking issues, and the developer's responsibility to the property owners.

RECOMMENDATION:

That Town staff and the developer work with the residents to find a solution to the placement of sidewalks on Irish Rose Drive;

 

And that the matter of sidewalks on Irish Rose Drive be brought before Council in October, 2001.

 


 

5.         MICROCELL CONNEXIONS, 11288 KENNEDY ROAD
APPLICATION FOR COMMUNICATIONS TOWER (SC 01 100540) (10.0)

 

Angela Burley of Microcell Connexions, was in attendance regarding a proposed telecommunications tower at 11288 Kennedy Road, south of 19th Avenue. The Committee received a suggested draft resolution for consideration.

RECOMMENDATION:

That the site plan application submitted by Microcell Connexions for construction of a 48 metre (157.5 ft.) telecommunications tower at 11288 Kennedy Road be approved, with respect to location only, subject to the following conditions:

-           That Industry Canada be advised, in writing, of this approval and that this approval is with respect to location only; and

-           Microcell Connexions are responsible for all matters relating to grading, utility location, external approvals, engineering and structural design, etc.

 

 

6.         "CORNELL VISION GETS A BOOST"

RECOMMENDATION:

 

That the newspaper article entitled " Cornell Vision Gets A Boost" from the Toronto Star dated September 8, 2001, be received for information.

 

7.         "NEW PARTNERS FOR SMART GROWTH"
CONFERENCE INFORMATION (10.0)

RECOMMENDATION:

 

That the information regarding the "New Partners For Smart Growth" conference, to be held in San Diego, California, on January 24-26, 2002, be received for information.

 

 

8.         "GREENSPACE PROJECT - PICKERING LANDS"
NOTICE OF OPEN HOUSE (10.0)

 

RECOMMENDATION:

 

That Transport Canada's Notice of Open House regarding "Greenspace Project on the Federally Owned Pickering Lands" held on September 6, 2001, be received for information.


 

9.         MARKHAM BY-PASS EXTENSION, HWY 407 TO MORNINGSIDE
REPORT OF YORK REGION'S TRANSPORTATION AND WORKS
COMMITTEE, AUGUST 29, 2001(13.4.3) (5.10)

RECOMMENDATION:

 

That the report of York Region's Transportation and Works Committee, dated August 29, 2001 regarding the Markham By-pass extension, Highway 7 to Morningside Avenue, be received for information.

 

 

10.       1456217 ONTARIO INC., BLOCK 39, REGISTERED PLAN 65M-3226
LEITCHCROFT PLANNING DISTRICT, ZONING BY-LAW AMENDMENT
TO PERMIT A LONG-TERM STAY HOTEL (ZA 01 111852) (10.5)

 

RECOMMENDATION:

 

That a Public Meeting be held to consider the application by 1456217 Ontario Inc. for approval of a Zoning By-Law Amendment (ZA 01 111852) to permit a long term stay hotel on Block 39, Registered Plan 65M-3226 in the Leitchcroft Planning District.

 

 

11.       EUGENIO GARRITANO, 355-357 MAIN STREET MARKHAM NORTH
APPLICATION FOR REZONING (ZA. 99-029954) FOR TWO
SEMI-DETACHED DWELLINGS AND RESTORATION OF HERITAGE
BUILDING (10.5)

 

Councillor  Virgilio disclosed an interest with respect to the proposed rezoning of 355-357 Main Street Markham North by Eugenio Garritano, by nature of representing a mortgage holder on the subject property, and did not take part in the consideration or discussion of or vote on the question of the approval of such matter.

 

RECOMMENDATION:

That a Public Meeting be held to consider the rezoning application (ZA. 99-029954) by Eugenio Garritano, to permit the construction of two semi-detached dwellings and restoration of the existing detached dwelling at 355-357 Main Street Markham North.


 

12.       GREEN LANE INVESTMENTS INC., 201 HUNTINGTON PARK DR.
APPLICATION FOR OFFICIAL PLAN AND ZONING BY-LAW
AMENDMENTS TO PERMIT THREE SINGLE DETACHED DWELLINGS
(OP.01-108523, ZA.01-108365) (10.3, 10.5)

 

RECOMMENDATION:

That a Public Meeting be held to consider the Official Plan and Rezoning applications (OP.01-108523 and ZA.01-108365) by Green Lane Investments Inc. at 201 Huntington Park Drive.

 

13.       PREPARATION OF AN OFFICIAL PLAN AMENDMENT
FOR LANDS IN THE RODICK ROAD & HIGHWAY 407 AREA (10.3)

 

RECOMMENDATION:

 

That staff be directed to prepare and report on a draft Official Plan Amendment(s) to designate lands in Rodick Road/Highway 407 area for industrial use and to establish policies for further study and approval of the lands for industrial development.

15.       1438670 ONTARIO INC., 159 AND 159A MAIN STREET UNIONVILLE
ZONING BY-LAW AMENDMENT (ZA. 01-108462) (10.5)

 

The Chair advised that the subject of the Public Meeting this date was to consider application ZA.01-108462 for a zoning by-law amendment, submitted by 1438670 Ontario Inc., to permit an inn/hotel use at 159 and 159A Main Street, Unionville.

Committee was advised that 36 notices were mailed on August 29, 2001 and a public meeting sign was posted August 21, 2001. Committee received two written submissions from:

1)         Jack Valaines, 1438670 Ontario Inc, dated September 6, 2001, responding to concerns;

2)         Gary Davis and Karen Davis, 159 Main Street, Unionville, dated September 17, 2001, expressing concerns.

Committee also received a revised suggested draft resolution from staff.

 

Staff gave a presentation of the proposal, explaining the location, surrounding uses, and proposed uses. It was explained this application deals only with the use, and that details such as parking will be dealt with through the site plan process.

 

Jack Valaines, applicant, stated his understanding that parking issues will have to be resolved.

 

Gary Davis, 159 Main Street Unionville, L3R 2G8, stated he is a tenant of the subject building. He expressed concerns for adequate parking, and possible obstruction of the access to parking. 


 

Karen Davis, 159 Main Street Unionville, L3R 2G8, as a member of the Unionville BIA, stated concerns for adequate parking.

 

Doug Worsley, 6C Station Lane, Unionville, L3R 1R3, stated he is a Director of the Village of Unionville Property Owners Association, as well as a resident. He advised that he is in support of this proposal, however, he does have concerns about the parking issue.

 

RECOMMENDATION:

That the Record of the Public Meeting held on September 18, 2001 with respect to application ZA.01-108462 for a proposed zoning by-law amendment to By-law 122-72, as amended, for 159 and 159A Main Street, Unionville (1438670 Ontario Inc.) be received;

And that application ZA.01-108462 be referred back to staff for a report evaluating the proposal.

16.       TENSTONE DEVELOPMENT INC., HIGHWAY 7, TOWN CENTRE   BOULEVARD, COX BOULEVARD AND RODICK ROAD
OFFICIAL PLAN AND ZONING BY-LAW AMENDMENTS

The Chair advised that the subject of the Public Meeting this date was to consider a Precinct Plan, and applications for Official Plan and Zoning By-law amendments OP 1109197 and ZA 01007910, submitted by Tenstone Development Inc. to permit mixed use development, north of Highway 7, between Town Centre Boulevard, Hydro Corridor and Cox Boulevard.

Committee was advised that 472 notices were mailed on August 29, 2001. Two public meeting signs were posted August 29, 2001. One hundred and ninety written submissions were received prior to the meeting, and 13 written submissions and two petitions were received during the meeting. The Committee also received a revised suggested draft resolution from staff.

Staff gave a presentation to explain the proposed Precinct Plan, and Official Plan and Zoning By-law amendments to permit mixed use development. The key issues of building height, retail/office component, and traffic, were reviewed.

 

Ian McLeod and Rob Marshall were in attendance representing Tenstone Development. Their presentation reviewed the Precinct Plan, proposed uses, density, height, open space and linkages, pedestrian walkways, grading, elevations, streetscape, setbacks, and parking issues. Steve Upton of Tridel, displayed elevations and site plans for the proposed 16-storey high rises. Nick Poulos, Transportation Engineer for the applicant, discussed traffic, access, parking, internal circulation, and intersection issues for Markham Centre.

Members of the public identified their concerns as: proposed density and building height; a significant change to the original plan is being proposed; overcrowding in schools; traffic increase and related safety of pedestrians, noise, air quality; cumulative effects when approved development along Apple Creek is completed; effects on overall community and quality of life; congestion for emergency vehicles; and snow removal. Members of the public expressed their opinions regarding the quality of work done by Tenstone Development. Comments were also expressed that the Transportation Study had not been provided in sufficient time for proper review, and that the public wishes to review the required impact studies prior to Council making a decision.


 

Speakers presented the Committee with a petition of over 300 signatures in objection to the proposal.

 

Staff explained the framework for higher density has already been established in the Secondary Plan, consistent with the vision for Markham Centre.

 

Committee expressed concern for appropriate uses and density, and the need for innovative solutions to issues. It was explained that funding for infrastructure projects such as schools and libraries comes from building permits issued to developers, and that the overcrowding of schools is the jurisdiction of the Board of Education. Committee also discussed the adequacy of information provided to property purchasers, regarding surrounding development.

 

Staff advised a final report with a recommendation is anticipated to be presented to the Committee in 8 to 10 weeks. The Committee directed that the issue of construction traffic be addressed in the report, and that all people receive notice when it is brought before the Committee.

 

RECOMMENDATION:

 

That the Record of the Public Meeting held on September 18, 2001, with respect to the proposed Precinct Plan, Official Plan and Zoning amendments (OP 01109197 and ZA01113929) for Tenstone Development Inc., to permit mixed use development north of Highway 7, between Town Centre Boulevard, Hydro Corridor and Cox Boulevard, be received;

 

And that the Precinct Plan and applications by Tenstone Developments Inc. to amend the Official Plan (Markham Centre Secondary Plan, OPA 21) and By-law 165-80, as amended, be referred back to Planning staff for a final report and recommendation, including addressing the issue of construction traffic;

 

And that all the people who spoke at the Public Meeting, made a written submission, or signed a petition, be notified when the final report and recommendation is presented to the Committee, and also that a notice be published in the Markham Economist and Sun Newspaper.
