TO BY-LAW 218-89 (5.10)

 

That the application by McNally International Inc. for an exemption to the Town’s Noise By-law 218-89 to extend the hours of work for the construction of the 9th Line Sewer, be granted, as follows:

 

- York Durham Sanitary Sewer     - January 2001 – August 2001

                                               - 1900 – 2300 hours to permit 2-8hour shifts

                                               - 2300- 0500 hours to permit a 6 hour maintenance shift
                                              

- Delmark Boulevard (C1)            - January 2001 – August 2001
                                         - 1900 – 2300 hours to permit 2-8 hour shifts

And that the approval of the above exemptions is subject to the following conditions:

 

-         noise levels emitting from the shaft meet Ministry of the Environment Guidelines and Town By-law 218-89 (maximum 85 decibels)

-         appropriate muffeling devices be installed on the cranes

-         shaft flood lights be shielded to minimize light pollution

-         heavy truck access to shaft access be prohibited from 1900 hours to 0700 hours

-         shaft areas at YDSS, Delmark and 9th/16th Avenue be enclosed by a minimum 3.7 m high insulated hoarding; shaft areas at Church Street, Markham By-pass, and Little Rouge Creek be enclosed by a minimum 2.4 m height insulated hoarding

-     follow-up noise monitoring be undertaken as required by the Town

-     Region of York and McNally monitor the impact on existing residents in the vicinity of the shafts and address any concerns

-     McNally address water concerns to the satisfaction of the Region of York and Ministry of the Environment and all complaints and actions with regard to wells and water be copied to the Community Services Commission

-     Town’s right to rescind the exemption if McNally fails to comply with the above conditions

Mr. Patterson was in attendance to present a donation towards the Comfort Bear Program.

 

Members of the Markham Fire & Emergency Services Crew 959 were in attendance along with Fire Chief Jim Sales and Deputy Chief Don McClean.

 

(2)        WASTE REDUCTION WEEK – APPRECIATION
TO STAFF (5.1 & 12.2.6)

 

Shayne Hartin and Leigh Gibson, Environmental Inspectors with the Waste Management Department, were in attendance to receive Council’s recognition for their exemplary efforts during Waste Reduction Week.

 

 


 

5(a)      REPORT NO. 8 OF THE FINANCE & ADMINISTRATIVE COMMITTEE

 

Council consented to the withdrawal of Clause (1).

That a by-law to licence and regulate adult video stores be presented for three readings;

 

And That the Planning Department prepare a further report to address any Official Plan amendments and rezoning required to permit this land use within Industrial zones;

 

And That By-law 73-98 be hereby repealed in its entirety.

(2)        MARKHAM FOOD BANK
– REQUEST FOR ASSISTANCE (8.5)

 

That an interest free loan be approved for the Markham Food Bank in the amount of $12,000 to cover the gross lease expenses from April 1, 2001 to March 31, 2002 from an account to be specified by the Treasurer;

 

And That the Markham Food Bank be encouraged to seek corporate sponsorship or other funding sources to repay the loan and address future lease payment requirements.

Amended by Council on February 13, 2001 to read as follows:

 

That a grant in the amount of $36,000 be approved to cover the gross lease expenses of the Markham Food Bank from April 1, 2001 to March 31, 2004 from an account to be specified by the Treasurer;

 

And that the Markham Food Bank be encouraged to seek corporate sponsorship or other funding sources to address future lease payment requirements.

 


 

(3)        CONVEYANCE OF PART OF WALKWAY TO
RUST DEVELOPMENTS LTD.(8.7)

 

That part of Block 260, 65M-3078, designated as Part 93, Plan 65R-20992, be declared surplus property pursuant to Town of Markham By-law No. 178-96;

 

And That notice of the proposed disposition of such lands be placed on the agenda for the Council meeting of January 30, 2001, also as required by Town of Markham By-law 178-96;

 

And Further That a by-law be enacted at the Council meeting on February 13, 2001, authorizing the Mayor and Clerk to execute a Transfer/Deed of Land to Rust Developments Ltd. for lands legally described as Part of Block 260, Plan 65M-3078, designated as Part 93, Plan 65R-20992, in form satisfactory to the Town Solicitor.

 

 

 

(4)        LETTER OF INTENT FOR GRANT
- ONTARIO SUPERBUILD CORPORATION (7.12.3 & 6.6)

 

That Council confirms that the Town of Markham is compliant or in the progress of gaining compliance with the new Ministry of Environment Drinking Water Protection Regulation, Ontario Regulation 459/00 made August 9, 2000 (“DWPR”);

 

And That Council considers the Angus Glen Community Centre and Library to be its highest sport, recreational, cultural or tourism infrastructure priority;

 

And That Council confirm the Town of Markham does not have any outstanding public health and safety issues or projects affecting its existing sport, recreational, cultural and tourism facilities;

 

And That the Clerk submit a letter of intent to the Ontario SuperBuild Corporation respecting the qualification of the Angus Glen Community Centre and Library for funding under Round 1 of SuperBuild Sports, Cultural and Tourism Partnership initiative for the amount of $2,983,820 to be adjusted to reflect the increase in the cost of construction from 1998 to the proposed tendering date of fall 2001 based on the Statistics Canada non-residential build price index;

 

And that a copy of this motion be forwarded to the three local MPP’s.

AT MAIN EASTERLY DRIVEWAY OF
200 BULLOCK DRIVE (LOBLAWS) (5.12.1)

 

That Schedule 19 of General Traffic By-law Number 106-71, pertaining to Traffic Control Signals, as amended, be further amended to include Traffic Control Signal at the intersection of Bullock Drive and the main easterly driveway of 200 Bullock Drive (Loblaws), located 254 metres east of McCowan Road.

(2)        MAIN STREET UNIONVILLE SOUTH, HEAVY TRUCK
TRAFFIC PROHIBITION (5.12)

 

That Schedule 14 of Traffic By-law Number 106-71, be amended to include Heavy Traffic Prohibition on Main Street Unionville South, between Highway #7 and Unionville Gate;

 

And That the Roads Department be authorized to install a truck prohibition sign in each direction of Main Street Unionville South between Highway #7 and Unionville Gate upon approval of the by-law;

 

And Further That York Regional Police be requested to enforce the Heavy Traffic Prohibition upon approval of the by-law amendment and installation of the appropriate signage.

(3)        ALDERGROVE DRIVE AND TEDDINGTON AVENUE
ALL-WAY STOP CONTROL (5.12.3)

 

That Schedule 12 of By-law 106-71 for an all-way stop control be amended to include Aldergrove Drive and Teddington Avenue and that the by-law be recommended to Council for adoption;

 

And Further That York Regional Police be requested to enforce the all-way stop control upon installation of these signs.

(4)        TRAFFIC CONTROL BY-LAWS FOR NEWLY ACCEPTANCE
FOR MAINTENANCE – 65M-3080; 65M-3177; 65M-2999 (5.12.3)

 

That Schedule “12” of Traffic By-law Number 106-71, be amended to include compulsory stop to the indicated streets named on By-law 2001-50;

 

And Further That Schedule “A” of Traffic By-law Number 105-71, be amended to include a maximum speed of 40 kilometers per hour to the indicated streets named on By-law 2001-51.

(5)        REVIEW OF ON-STREET PARKING NEEDS
ON LAURELEAF ROAD (5.12.4)

 

That Schedule 1 of Parking By-law 336-88, as amended, be further amended to rescind the “No Parking Anytime” restriction on the west side of Laureleaf Road from Steeles Avenue to a point 76 meters north of Steeles Avenue;

 

And That Schedule 1 of Parking By-law 336-88, as amended, be further amended to include a ‘No Parking Anytime’ restriction on the west side of Laureleaf Road from Steeles Avenue to a point 130 meters north of Steeles Avenue;

 

And Further That Mr. Rob Mikitish of 3 Laureleaf Road be advised of these recommendations and the Parking Control Division of By-law Enforcement be requested to enforce the “No Parking” restrictions on Laureleaf Road, upon installation of the signs.

(6)        UPDATE ON THE WASTE MANAGEMENT DEPARTMENT’S
BAG-BASED COLLECTION PILOT PROJECT (5.1)

 

That Council endorse the extension of the Bag-It pilot project to May 2001.

 

 

(7)        APPROVAL FOR THE WASTE MANAGEMENT
DEPARTMENT’S AUTOMATED CART-BASED
COLLECTION PILOT PROJECT (5.1)

 

That Council approve the implementation of an Automated Cart-based Collection pilot project in Ward 5 for a six-month period from April to the end of September;

 

AND THAT Council approve Town funding of this project in the amount of $110,000 with $60,000 of this total being transferred from the 2000 Capital Project #2701 (Account 62-5350-2701-005) for the Bag-It pilot project and the remaining $50,000 being derived from pre-approval of the Waste Management Department’s 2001 capital budget request for this project;

 

And That subject to approval of staff’s $100,000 grant application to the Federation of Canadian Municipalities (FCM) Green Municipal Enabling Fund (GMEF) for this project, Council authorize staff to return $100,000 to the appropriate reserve to offset the $110,000 Town expenditure for this project;

 

And Further That staff report back to Council prior to the end of the six-month pilot period with an update report, and possible extension of the pilot project in order to gain winter experience with this collection system, the funding of which to be determined at that time.

 

 

 

(8)        A BY-LAW TO PROHIBIT OR REGULATE
THE PLACING OR DUMPING OF FILL OR
ALTERING THE GRADE OF LAND (2.0 & 5.1)

 

THAT a by-law be enacted to prohibit or regulate the placing or dumping of fill, or altering the grade of land in the Town of Markham.

(2)        TOWN OF AJAX, RESOLUTION REGARDING
PLANNING APPLICATIONS (10.0)

 

That Markham support the request of Mr. Steve Parish, Mayor of Ajax, to the Honourable Tony Clement, Minister of Municipal Affairs and Housing, that the Province take the necessary steps to amend the Planning Act regulations with respect to the requirements for a complete application, and that the Ministry of Municipal Affairs and Housing be advised accordingly.

 

 

 

(3)        ENVIRONMENTAL INDEMNIFICATION AGREEMENT
PROPOSED LAND EXCHANGE,  WARDEN & HWY 7 (8.5)

 

That the Mayor and Clerk be authorized to execute an agreement between the Town of Markham, Petro-Canada, 1321365 Ontario Limited (in association with Leisureworld Incorporated and Embassy Suites Hotel) and Merkur (current vendor of the Petro-Canada site at Warden Avenue and Hwy 7) regarding the decommissioning of the existing Petro-Canada site to the satisfaction of the Commissioner of Development Services and the Town Solicitor.

 

 

 

(4)        PROPOSED TOUR OF NORTH AMERICAN CITIES (10.0)

 

That approval be granted for a Council orientation session, "Tour of North American Cities", for the development of Markham Centre, as follows:

            Three tours, for all of Council and 6 staff

            Miami/Washington (4 nights)

            Dallas/Chicago (4 nights)

            Los Angeles/Seattle/Portland (5 nights)

            at a cost of  $ 54, 979, using Saturday travel.

-the upset for the Class Environmental Assessment (Class EA) of Ninth Line (Y.R.69) from Highway 47 to Main Street (Stouffville), in the Towns of Markham and Whitchurch Stouffville, carried out by URS Cole Sherman, be increased by $32,965 from $109,665 to $142,630, excluding GST;
-the upset fee for the Class Environmental Assessment (Class EA) and detail design of the McCowan Road (Y.R.67) and Kennedy Road (Y.R.3) projects from 16th Avenue (Y.R.73) to Major Mackenzie Drive (Y.R.25), in the Town of Markham, which is being carried out by Earth Tech Canada Inc. be increased by $121,700 (32,000 for Town of Markham works) from $189,380 to $311,080, excluding GST.

42-2001      ASSOCIATION OF MUNICIPALITIES OF ONTARIO Member Communication advising that a class action lawsuit against all municipal electrical utilities in Ontario claims $500 million in restitution for all late payments on overdue bills since April 1981 and the Municipal Electric Association has asked AMO to alert municipalities who have sold their electric utilities that it is possible that the potential liability associated with this legal action will remain with the municipality. 43-2001      ASSOCIATION OF MUNICIPALITIES OF ONTARIO Member Communication advising the Ontario Energy Board’s Report sets out some major gains for AMO’s members, in particular improvement to Model Gas Franchise Agreement which allows the municipality to charge  permit fees which reasonably reflect the costs incurred by the municipality in issuing permits for construction activities by gas companies, but falls short of granting the authority to obtain compensation for use of rights-of-ways. (13.12.2)

 

44-2001      ASSOCIATION OF MUNICIPALITIES OF ONTARIO Member Communication advising The Ontario Labour Relations Board has issued a decision that will only allow plumbers to install municipal water meters which could impact municipalities, their operations and costs. (13.12.2)
