The Town Clerk and Manager of Secretariat gave a brief presentation outlining recent improvements to the Council agenda format.

Committee requested that citizen appointments be advertised in the local newspaper and notification also be placed in the local community centres and libraries.  Committee also requested that information about appointments, including the application, be put on the Town’s website.

4.         McNALLY INTERNATIONAL INC. - 9TH
            LINE SEWERS - REQUEST FOR EXEMPTION
            FROM THE NOISE BY-LAW (5.10)

 

Council, at its meeting held on December 12, 2000, received a report from the Engineering Department regarding an application by McNally International Inc. to extend the hours of operation for the construction of the Ninth Line sewer from approximately 14th Avenue to north of 16th Avenue.  Council deferred the matter until such time as Markham Subcommittee could meet with the residents and representatives of McNally International.

 

The Markham Subcommittee, at its meeting held on January 15th, 2001, met to receive public input and a presentation from McNally and passed a resolution with respect to the subject request.

 

Development Services Committee, at its meeting held on January 22nd, 2001 referred the matter to Committee of the Whole this date.

 

Mr. Stan Holden of MacViro was in attendance along with Mr. Kees Schipper, Commissioner, Transportation and Works, The Regional Municipality of York in support of such request.

Mr. John Bigioni was in attendance to express concern with respect to the wells in the area.

 

Mr. Murray Malott of McNally International was also in attendance and advised that the water situation is being reviewed and monitored by the Ministry of the Environment and The Regional Municipality of York.  Until the review is complete, water is being supplied where required.


 

Committee discussed changes to the recommendation of the Markham Subcommittee.

 

            RECOMMENDED:

 

That the application by McNally International Inc. for an exemption to the Town’s Noise By-law 218-89 to extend the hours of work for the construction of the 9th Line Sewer, be granted, as follows:

 

- York Durham Sanitary Sewer     - January 2001 – August 2001

                                               - 1900 – 2300 hours to permit 2-8hour shifts

                                               - 2300- 0500 hours to permit a 6 hour maintenance shift
                                              

- Delmark Boulevard (C1)            - January 2001 – August 2001
                                         - 1900 – 2300 hours to permit 2-8 hour shifts
                                        

                                                     - May 2001 – October 2001
                                         - 1900 – 2300 hours to permit 2-8 hour shifts

                                                     - 2300 to 0500 to permit a 6 hour maintenance shift

                                                    

- Church Street (C3)                     - No exemption

 

- 9th/16th Avenue (C4)                  - January 2001 – September 2001
                                                     - 1900 –2300 hours to permit 2-8 hour shifts

- Markham By-pass (C9)              - January 2001 – September 2001
                                                     - 1900 – 0100 hours
                                                     - permit 2-9 hour shifts and use of generator for tunnel
                                                        boring machine

- Little Rouge Creek (C5)             - January 2001 – May 2001
                                                     - 1900 – 0100 hours
                                                     - permit 2–9 hour shifts and use of generator for tunnel
                                                        boring machine


 

And that the approval of the above exemptions is subject to the following conditions:

 

-            noise levels emitting from the shaft meet Ministry of the Environment Guidelines and Town By-law 218-89 (maximum 85 decibels)

-            appropriate muffeling devices be installed on the cranes

-            shaft flood lights be shielded to minimize light pollution

-            heavy truck access to shaft access be prohibited from 1900 hours to 0700 hours

-            shaft areas at YDSS, Delmark and 9th/16th Avenue be enclosed by a minimum 3.7 m high insulated hoarding; shaft areas at Church Street, Markham By-pass, and Little Rouge Creek be enclosed by a minimum 2.4 m height insulated hoarding

-            follow-up noise monitoring be undertaken as required by the Town

-         Region of York and McNally monitor the impact on existing residents in the vicinity of the shafts and address any concerns

-         McNally address water concerns to the satisfaction of the Region of York and Ministry of the Environment

-         Town’s right to rescind the exemption if McNally fails to comply with the above conditions
