3)         That Staff be directed to undertake a comprehensive review, including consultation with the Board of Management of the MBIA to determine further governance improvements and report back prior to the end of the 4th quarter of 2015; and further,

2)         That Schedule 12 of Traffic By-law 106-71, pertaining to compulsory stops, be amended to include all approaches to the intersection of Cox Boulevard & Circa Drive; and,

 

3)         That Schedule 12 of Traffic By-law 106-71, pertaining to compulsory stops, be amended to include all approaches to the intersection of South Park Road & Times Avenue; and,


 

4)         That the Operations Department be directed to install the appropriate signs and pavement markings at the subject locations; and,

 

5)         That the cost of materials and installation for the traffic signs and pavement markings be funded from capital project #14228 (Traffic Operational Improvements) in the amount of $1,000; and,

 

6)         That York Regional Police be requested to enforce the all-way stop control upon installation of these stop signs and passing of the By-law; and further

 

7)         That staff be authorized and directed to do all things necessary to give effect to this resolution.

1)         That the report entitled “Proposed Northbound Left Turn Restriction at Ninth Line & Berczy Gate,” be received; and,

 

2)         That the petition submitted by Mr. Gord Walter, President of the Sherwood Amber Glen Ratepayers Association for a northbound left turn restriction on weekdays between 7 AM and 9 AM at the intersection of Ninth Line and Berczy Gate be received; and,

 

3)         That the Region of York be requested to implement a northbound left turn restriction at the intersection of Ninth Line and Berczy Gate, weekdays, between 7 AM and 9 AM; and,

 

4)         That York Region be requested to review the intersection of Ninth Line and Church Street for consideration to provide a northbound advance left turn signal combined with an advance straight through movement; and,

 

5)         That Markham staff request York Region Transit to review their transit route in an effort to capture more students travelling from the southeast part of Markham that attend Markham District High School by increasing their routes and/or provide for additional buses; and,


 

6)         That Markham staff be directed to contact the York Region District School Board and investigate the possibility of providing a school bus for students coming from the southeast part of Markham attending Markham District High School; and,

 

7)         That the deputation from Gord Walter, Sherwood Amber Glen Ratepayers Association be received; and,

 

8)         That Markham staff be requested to report back to General Committee regarding their recommendation; and further,

 

9)         That Staff be authorized and directed to do all things necessary to give effect to this resolution.

1)         That as recommended by Heritage Markham, the Joseph Wideman House at 10015 Highway 48 be declared eligible for relocation to Markham Heritage Estates, due to its cultural heritage value or interest, threatened state, the absence of either short or long-term uses by the owner, and the length of time before development will occur in the area; and,

 

2)         That Staff be authorized and directed to do all things necessary to give effect to this resolution.

Whereas a number of reports pertaining to the proposed GTA Centre Arena was commissioned by the City of Markham; and,

 

Whereas these reports continue to be unavailable for Markham Residents to review; and,

 

Whereas the release of these reports would not divulge any information on issues that warrant being kept confidential; and,


 

Whereas all meetings held at Markham Council could be public.  The Municipal Act does not mandate Council to go in camera for any reason other than a request within the Freedom of Information;

 

Now therefore be it resolved:

 

1)         That all such reports, slide show presentations and related documents be immediately released to the public, including the scope of work requested and including those authored by:

(1)        Miller Thompson - Power Point presentation

(2)        KPMG Reports

            -           Markham Sports Entertainment and Cultural Centre Project Highlights

            -           Assisting the Town of Markham in pursuing a Sports and Entertainment facility as a public private partnership

(3)        Weir Foulds

            -           How to make this a Municipal Capital Facility

            -           How the potential Centre transaction might be structured

            (4)        BDR - Opinion Letter and Report presentation

Ruling on the proposed motion to be out of order:

Mayor Frank Scarpitti ruled the proposed motion titled "Make all reports related to the GTA Arena public, including the scope of work asked for from each consultant" to be out of order as it contravenes with Municipal Freedom of Information & Protection of Privacy Act (MFIPPA) and City of Markham's Council Code of Conduct.  There was no challenge to this ruling from Members of Council.

 


 

Staff Presentation:

Kimberley Kitteringham, City Clerk, provided a PowerPoint presentation titled "Municipal Freedom of Information & Protection of Privacy Act (MFIPPA) Overview".  The presentation outlined the purposes of the Act, the exemptions and access rights of Council and staff recommendations in regard to the release of the documents.

1)         That the confidential Staff memorandum titled “Minor Variance Appeal, 8190 Bayview Avenue, First Capital (Bayview) Corporation., File A/41/14” dated February 10, 2015, be received; and,

 

2)         That Council direct Staff not to attend the Ontario Municipal Board (“OMB”) Hearing regarding the decision of the Committee of Adjustment to deny the requested minor variance, providing the applicant agrees to: a) request the OMB to implement the Staff recommended conditions of approval submitted to the Committee of Adjustment, and, b) continue to work with Planning & Urban Design Staff through the Site Plan Control application process to ensure that the drive-through facility complies with the Council endorsed Drive-through Facilities Design Guidelines; and further,


 

3)         That Staff be authorized and directed to do all things nessasary to give effect to this resolution.
