1.         DISCLOSURE OF PECUNIARY INTEREST

 

Councillor Virgilio disclosed an interest with respect to the proposed Plan of Subdivision and rezoning by Chiavatti, Kakalteris, Paraskevakos, Panaci, and Garritano for 102, 132, 156, 162, and portions of 138 Helen Avenue, by nature of having represented Garritano, one of the owners, and did not take part in the consideration or discussion of or vote on the question of the approval of such matter.

FOR THE YEAR 2000 (7.0)

 

That the report dated September 25, 2001 entitled "Provincial Performance Measures for the year 2000", be received;

 

And that staff publish the 14 mandatory Provincial performance measures on the Town of Markham website, the Town of Markham 2000 Annual Report, the Markham Economist and Sun and the Thornhill Liberal;

 

And that Council approve the release of additional efficiency & effectiveness measures in a manner similar to that of the mandatory Provincial performance measures.

1.   Petition signed by 19 residents in opposition to a GO Transit Station at Centennial Community Centre, which reads as follows:

 

'We do not want a GO Station at Centennial Park - Community Centre'.

 

2.   Petition signed by 40 residents in opposition to a GO Transit Station at Centennial Community Centre, which reads as follows:

 

      'We, the undersigned, oppose the proposed GO Station at Centennial Centre.  We believe it will jeopardize the safety of the residents and will reduce accessibility to existing recreational facilities.  Do not put the convenience of a few commuters ahead of the safety of our children and seniors.  Do not compromise the future of our Recreation Centre.'

 

3.   Petition signed by 70 Residents in opposition to a GO Transit Station at Centennial Community Centre, which reads as follows:

 

      'We, the undersigned, would like it to be known that we adamantly protest the proposal by GO Transit to build a new station north of Markham's Centennial Community Centre (McCowan @ Bullock) and to take over half of the centre's parking (about 260 spots) for GO passengers; along with its proposal to add a new Bullock Drive entrance to the centre.  We also strongly protest the 2nd phase of this proposal to add another 653 parking spaces to this station location and add a new entrance from McCowan Road.  We protest said proposals for reasons including, but not limited to, the following: unmanageable traffic, safety concerns (especially for children), decrease in surrounding property values, lack of parking available for community centre members & visitors, proposed site is in the middle of a residential community and recreational parkland.'

 

4.   Petition signed by 112 residents in opposition to a GO Transit Station at Centennial Community Centre, which reads as follows:

 

      'We the citizens of Markham, STRONGLY oppose the building of a go Station at the Centennial Community Centre on Bullock Dr.  PLEASE DO NOT DESTROY OUR RECREATIONAL FACILITIES.'


 

5.   Petition signed by 98 residents in opposition to a GO Transit Station at Centennial Community centre, which reads as follows:

 

      'This petition by the citizen of Markham against the building of a GO station at the Centenial Community Centre.'

7(a)      REPORT NO. 59 - COMMISSIONER OF COMMUNITY SERVICES

 

Council consented to amend Clause (1) and add Clause (2).

That Report No. 59 - Commissioner of Community Services be received and adopted.

 

(1)        GO TRANSIT PARKING AT CENTENNIAL
COMMUNITY CENTRE (5.14.2 & 5.12.4 & 6.6)

 

That Council approve the new GO Transit Station and shared parking at the Centennial Community Centre subject to the following conditions:

 

1)         That GO Transit be provided a maximum of 200 parking spaces located at the north-west area of the site as shown on Appendix ‘A’, and that any increase in ridership has to be accommodated with off site parking and shuttle service.

 

2)         That a new signalised access at the west limit of the Community Centre be constructed at an estimated cost of $85,000.

 

3)         That Bullock Drive be widened to 5 lanes to provide a new left turn lane into the Community Centre at an estimated cost of $50,000

 

4)         That GO Transit and the Town cost share on a 50/50 basis, the road improvements identified in 2) and 3) above

 

5)         That the Town also pursue funding from the Region of York for the road improvements identified in 2) and 3) above

 

6)         That the Town’s portion of funding up to $67,500 for the road improvements be funded at the direction of the Treasurer


 

7)         That all other costs associated with the GO Station be at GO Transit expense including internal site works at the Community Centre

 

8)         That the term of the shared parking agreement be for 5 years

 

9)         That parking enforcement be provided by the Town at GO Transit expense

 

10)       That fire access be maintained

 

11)       That hours of operation for GO Transit parking be Monday to Friday, 6:00 a.m.-7:00 p.m.  At all other times, spaces will revert to Town use; it being understood that any vacant spaces after 9:00 a.m. may be used by the Town

 

12)       That GO Transit will not charge a parking fee

 

13)       That GO Transit obtain Town approval for any tree removal and be required to relocate or replace any tree removed

 

14)       That GO Transit submit a construction schedule to the Town

 

15)       That GO Transit provide insurance to the Town to be indemnified against all claims

 

16)       That GO Transit enter into an agreement with the Town to the satisfaction of the Chief Administrative Officer and Town Solicitor to be executed by the Mayor and Town Clerk

 

17)       That Town staff undertake an operational safety review of the Centennial Community Centre and report back  to Council well in advance of the opening of the GO Station, with such report to include recommendations on:

-        speed bumping the whole lot;

-        the possibility of closing the current entrance on Bullock Drive closest to McCowan Road;

-        the possibility of changing the current entrance on Bullock Drive durthest from McCowan Road to a right in/right out;

-        the addition of a right in/right out entrance on McCowan and the resulting reconfiguration of the lot;

-        the addition of protective fencing to the children's playground area;

-        any other safety related issues which the community, Council or staff deem appropriate;

-        barricades from east to west side of the parking lot so drivers coming through signalized entrance could not access the east side of the park

 

18)       That Town staff report to Council at the same time as (17) above on the feasibility of adding 50 to 75 more parking spots to the lot in 2002 for the benefit of recreation facility users only.

 

19)       That Town staff report to Council in 2002 on preliminary concepts for adding more parking at a future date and for expansion of Centennial Community Centre


 

20)       That detailed design of the proposed GO Station and parking lot not preclude the possible future expansion of the Centennial Community Centre;

 

21)       That The Region of York be requested to implement shuttle bus service to the GO Station at the Centennial Community Centre on opening;

 

22)       That Town of Markham staff be directed along with GO Transit staff to develop a GO Station plan for further public consultation.

(2)        PROPOSED SCHEMATIC DESIGN OF ANGUS GLEN
            COMMUNITY CENTRE AND LIBRARY (6.6)

That Council approve the Schematic Design of Angus Glen Community Centre and Library as presented by the Architect, Shore, Tilbe Irwin & Partners subject to satisfactory resolution of the site circulation concerns, and authorize the Architect to proceed with the Detailed Design;

 

And that staff contact the Region of York to request two full signalized accesses from Major Mackenzie Drive to the property;

 

And that Council approve a budget of $220,000 for the Detailed Design, to be funded from the Development Charge Reserve Fund;

 

And that Council approve proceeding on a Stipulated Sum Contract basis with a completion date of September 1, 2003, for the Arenas and August 31, 2004, for the remainder of the building;

 

And that Council endorse the Public Input and Media Strategy process as detailed in the report;

 

And that the notes from the Invited User Groups meeting held on September 21, 2001 be referred to staff for review;

 

And that Development Services staff prepare a detailed report on the design schedule and funding of the park for the Development Services Committee, and that the park not be included as part of the Project Budget at this time;

 

And that a Schematic Design estimate including the construction of the building and associated Fixtures, Furniture, and Equipment be established as follows:

            If the Library size is increased, that the budget be revised accordingly;

And further that the updated Recreation, Culture and Library Master Plan be provided to Council for their review;


 

And that the matter of the Library be deferred and referred to a Committee of the Whole meeting on Monday, October 1, 2001.

(1)        ASSESSMENT APPEAL PROCESS CHANGES (7.1)

 

That Council support a request to the Chair of the Assessment Review Board (ARB) for a review of the August 8, 2001 ARB decision which changed the historical practice of assessment appeal involvement by the Town of Markham.

 

 

(2)        536142 ONTARIO INC. - SALES TRAILER AGREEMENT
            LOTS 1, 2, 78, 79 AND 80, DRAFT PLAN 19T-95012 (8.4)

 

That the Town be authorized to enter into a Sales Trailer Agreement with 536142 Ontario Inc., with respect to Lots 1, 2, 78, 79 and 80 on Draft Plan 19T-95012 and the Mayor and Clerk be authorized to execute the agreement in a form satisfactory to the Town Solicitor.

That the Town be authorized to enter into a Model Home Agreement with 536142 Ontario Inc. with respect to Lots 3 and 4, on Draft Plan of Subdivision 19T-95012, and that the Mayor and Clerk be authorized to execute the agreement in a form satisfactory to the Town Solicitor.

(4)        YMCA WORLD PEACE WEEK, NOVEMBER 19, 2001 (3.4)

 

That Councillor K. Usman be appointed to the selection committee for a Markham Peace Medal recipient;

 

And that the week of November 19 be proclaimed YMCA World Peace Week in the Town of Markham;

 

And that permission be granted to hold the recognition event to honour the Peace Medal recipient in the Canada Room at the Civic Centre on November 20, 2001 at 7:00 p.m.

 

 

(5)        REVIEW OF PROPERTY ASSESSMENT PROCESS (BEAUBIEN) (7.1)

 

That Council endorse the following recommendations for submission to Mr. Marcel Beaubien, MPP, in the second phase of his review of the Property Assessment Process:

 

That in any review of property class definitions, complete consultation with municipalities, property owners and the Municipal Property Assessment Corporation (MPAC) be obtained to ensure the goals of simplicity and clarity are met;

 

And that a comprehensive valuation review of golf courses be undertaken to extend to golf courses beyond the GTA to the entire Province and for any review of special property valuations, all affected parties – including municipalities, property owners and MPAC - be involved;

 

And that the implementation of a sub-class for heritage properties by the Province be optional for municipalities and allow for the inclusion of mandatory criteria for properties to qualify for the sub-class  (such as Easement Agreements registered on title) to ensure the benefit is appropriately directed;

 

And that the MPAC funding formula be reviewed to take into account areas of high growth that require additional resources as well as an accounting for losses due to assessment appeals;

 

And that MPAC be required to ensure that the Vacancy Rebate application is returned to the municipality within 60 days of initial receipt from the taxpayer with the CVA calculation to allow the municipality time to process the rebate to meet the 120 day deadline from initial application date;

 

And that Council support the request for review of the August 8, 2001 Assessment Review Board (ARB) decision that changed the historical practice of assessment appeal involvement by municipalities in York Region, including Markham;

 

And that the Province review the option for municipalities to opt out of assessment service delivery by MPAC to permit a municipality to opt out based on clear standards established by the Province;


 

And that MPAC be properly resourced and staffed to meet the challenges of the assessment process including increased and improved communication between MPAC and municipalities.

That Schedule 12 of By-law 106-71, a by-law pertaining to compulsory stop signs, be amended to provide for an All-Way Stop Control at the intersection of Fred Varley Drive and Fonthill Boulevard;

 

And that School Crossing Guard service not be established at the intersection of Fred Varley Drive and Fonthill Boulevard;

 

And further that the York Regional Police be requested to enforce the all-way stop control upon installation of these signs.

That the memo from the Director of Engineering dated September 12, 2001, with respect to the Region of York – Yonge Street Transitway EA be received;

 

And that the letter from the Region of York dated September 11, 2001advising the Region “will revise the Draft Terms of Reference for the Yonge Street Transitway to include a stipulation that a final design for any interim solution for transit priority on Yonge Street be of sufficient dimensions and design to allow for the possible operation of LRT vehicles” be received;

 


And that the draft Terms of Reference dated May 2001 for the Yonge Street Transitway be endorsed subject to

 

a)                  the protection of Light Rapid Transit technology in the proposed transitway;

 

b)                  the Terms of Reference reflecting that the ultimate design for the Rapid Transit corridor will be equally compatible for both Light Rapid Transit and busway technology;

 

And that the Region of York be advised accordingly. 

 

 

(6)        Pacific Mall  (5.14)

 

Whereas the owners of Pacific Mall have undertaken a traffic operational study which identifies the need for a traffic signal on Steeles Avenue to improve safety and access to their site;

 

And whereas the minimum traffic signal warrants are satisfied at the Pacific Mall Driveway-
Redlea Avenue and Steeles Avenue intersection;

 

And whereas the City of Toronto has identified the intersection of Pacific Mall Driveway – Redlea Avenue and Steeles Avenue for signalization as part of the approved Environmental Study Report for the Steeles Avenue grade separation project;

 

*And whereas the owners of three properties, Kennedy Steeles Holdings, Market Garden, and Pacific Mall have agreed to contribute $100,000 towards traffic signals at the Pacific Mall Driveway-Redlea Avenue intersection;

 

Now therefore be it resolved that the Town of Markham advise the City of Toronto that the Town strongly supports the installation of traffic signals on Steeles Avenue as soon as possible, the preferred location being the Pacific Mall Driveway area and Redlea Avenue intersection;

 

And that Kennedy Road traffic improvements be implemented as soon as possible;

 

And that Town staff and the Pacific Mall Task Force monitor the success of these improvements.

And that the terms of reference to be developed by the Region ensure that the requirements of the Environmental Assessment Act will be met through the Transportation Study and the subdivision approval process relating to the proposed Woodbine Avenue By-pass;

 

And that the Town of Markham cost share in the Transportation Study to an upset limit (Markham share) of $20,000.00 plus GST  (Account # 08353993772005), to be recouped in a future area specific Development Charges By-law for the Cathedral Community Secondary Plan area;

ALTERATIONS & ADDITIONS (SC.00-246384) (10.6)

 

That the Development Services Commission Report entitled “York Region District School Board - Unionville High School - Application for Site Plan Approval  (SC.00-246384) to Permit Alterations and Additions”, be received;

And that the Town of Markham coordinate with the York Region District School Board and the Region of York potential cost-sharing, approvals and implementation of the recommended school access to Warden Avenue at the existing traffic signal located at Warden Avenue/Town Square Plaza;

And that the York Region District School Board/Unionville High School develop and implement a Student Travel Management Plan for Unionville High School to reduce the use of cars and identify opportunities for school busing and increased public transit usage for students, in consultation with Transit Authorities;

And that the Unionville High School continue to use both the Town Centre Boulevard and Apple Creek Boulevard accesses for student pick-up and drop-off;

And that the York Region Board of Education be required to expand the parking lot at Unionville High School by 102 parking spaces for a total of 273 parking spaces;

And further that the site plan application be approved subject to a site plan agreement being entered into by the York Region District School Board to include the following provisions:

1.   That revisions to the site plan necessary to reflect the recommendations of this report be incorporated into the final plans to be approved by the Commissioner of Development Services or designate;

2.   That the site plan, grading plan and landscape plan be approved by the Commissioner of Development Services or designate;

3.   That provision be included for the timing, funding and construction of the driveway access from to the existing signalized intersection at Warden Avenue/Town Square Plaza to the satisfaction of the Town and the Region of York;

4.   That provision be included for continued monitoring of parking and traffic demand for a period of up to 5 years and arrangements for any additional traffic and/or parking improvements to meet requirements;

5.   That standard provisions and requirements of the Town and public agencies be included;

6.   That provision be included for the watering and maintenance of the newly planted and relocated trees on the property; and,

7.   That provision be included for the payment of all applicable fees and recoveries.
