Meeting convened at 7:00 PM in the Council Chamber with Councillor
J. Webster in the Chair.

Mr. Biju Karumanchery,
Senior Development Manager advised that the subject of the Public Meeting this
date was to consider an application submitted by Delpark Homes (Bondbrooke)
Ltd., 2 Havelock Gate, south of 14th Avenue, east of Markham Road,
for Official Plan Amendment, Zoning By-law Amendment and Site Plan Approval (OP
09 113033, ZA 09 113040 & SC 09 113042).
The Committee Clerk advised
that 97 notices were mailed on August 19, 2009, and a Public Meeting sign was posted on August 17, 2009. Six
written submissions were received regarding this proposal.
Staff gave a presentation
regarding the proposal, the location, surrounding uses and outstanding issues. The presentation also included a brief
background history regarding the previously approved site plan for a
neighbourhood commercial plaza that was never constructed and the previous
applications for a seniors residence that were withdrawn.

Mr. J.R.
Bousfield, Bousfield Inc., addressed the Committee on behalf of the owner,
advising that the earlier proposal to construct a seniors residence was
strongly opposed by the existing community and that due to the change in the
senior care industry it was enough to discourage the owner from pursuing
it. He provided the Committee with
further details regarding the building heights, shadow casting, traffic
analysis and the policy context.
The Committee
stated concerns regarding the potential increase in traffic to an already congested
14th
Avenue
and Havelock Gate. Staff confirmed that
a traffic analysis has been submitted and reviewed by staff and the Region of
York. There was discussion regarding the
possibility of incorporating a right-in from 14th Avenue on the site.
Mr. Alfred Lai,
addressed the Committee on behalf of his parents who reside at 6 Havelock Gate, and spoke in opposition with respect to
the proposed application for 2 Havelock Gate. He
stated the following concerns: increase
in traffic on Havelock Gate, decrease in property values for the existing
community as a result of the anticipated commercial plaza being replaced by the
proposal and safety issues related to the future construction site if approved.
Mr. Adrian
Chandran, Rouge Fairways Residents Association, addressed the Committee with
respect to the proposed application at 2 Havelock Gate stating his strong opposition. He believes that this proposal is too large
for the site and incompatible with the existing community. Mr. Chandran is concerned with the extensive
asphalt proposed on site and the impact on green space, setback from 14th Avenue, the potential light pollution and the impact
on the existing neighbourhood schools.
Ms. Debbie Wong,
President, Rouge Fairways Residents Association, addressed the Committee
regarding the proposal at 2 Havelock Gate and spoke in opposition. She believes that this proposal does not
benefit the existing community and is not consistent with the Official Plan
policies. Ms. Wong is also concerned
with the impact on the existing neighbourhood schools and other infrastructure,
the proposed density, anticipated traffic issues, and setbacks. Ms. Wong also expressed concern regarding
property maintenance and the fact that the property is listed for sale. She noted that since the property is for sale
there is no guarantee that the approved site plan will be honored.
Ms. Gina Daya,
Rouge Fairways Residents Association, addressed the Committee with respect to
the proposed application at 2 Havelock Gate and stated her opposition. Her main concerns are: safety, traffic and parking. Ms. Daya believes that the visitor overflow
parking will end up on Havelock Gate.
She suggested that a new traffic study should be submitted. She also mentioned that the trees on Havelock
Gate have been hit many times that the Town no longer replaces them.
Mr. Chris
Pavlakis, 39 Carolwood Crescent, addressed the Committee regarding the proposal
at 2 Havelock Gate and spoke in opposition. He believes that this proposal, if approved
will have a negative affect on the existing communities in the area.
Mr. Faiz Shaikh, 93 Elvira Crescent, addressed the Committee with respect to the
proposed application at 2 Havelock Gate, stating he is not in support.
His main concern is the potential increase in traffic to an already
extremely congested area.
Mr. J.T. Brazier, 57 Boxwood Crescent, addressed the Committee regarding the proposal
at 2 Havelock Gate and spoke in opposition. He believes if this proposal is approved it
will have an adverse affect on the existing communities. Mr. Brazier is concerned that the proposed
number of visitor parking will not be sufficient and that the overflow will end
up on the residential streets. He would
like to see this site developed for single family dwellings.
Mr. Tom Tse, 8 Teversham Court, addressed the Committee with respect to the
proposed application at 2 Havelock Gate and spoke in opposition.
He believes that the proposed 4 storey building will not fit in with the
existing community. Mr. Tse stated the
following concerns: impact on the two
existing schools, potential light pollution, lack of greenspace and the
potential decrease in property values.
He requested that this application be refused.
Mr. Robert Doi, 26 Bluebell Drive, addressed the Committee regarding the proposal
at 2 Havelock Gate and spoke in opposition. His main concern is the potential increase in
traffic. He noted that most of the
traffic from the community uses Havelock Gate access to 14th Avenue. Mr. Doi
enquired about the tree replacement along 14th Avenue.
Mr. Antonio
Sciaraffa, 18 Bluebell Drive, addressed the Committee with respect to the
proposed application at 2 Havelock Gate and stated his opposition.
He does not understand why the owner continues to submit applications
that the residents are opposed to. Mr.
Sciaraffia enquired why the previous application to construct a commercial
plaza was never constructed.
Ms. Anna Searles, 109 Bretton Circle, addressed the Committee to state her
opposition with respect to the proposal at 2 Havelock Gate.
She believes that the site needs to be developed but with a proposal
that would fit in with the existing community.
Ms. Susanna
Baldassini, 3 Havelock Gate, addressed the Committee regarding the proposal at 2 Havelock Gate and spoke in opposition. She is concerned with the potential increase
in traffic to an already congested area, impact of neighbourhood schools and
the massing of the proposed building.

Bluebell Drive, addressed the Committee asking why is the site for sale prior to
it being developed?

Havelock Gate, addressed the Committee to state his
opposition with respect to the proposal at 2 Havelock Gate.
His main concern is the potential increase in traffic.
Staff advised that
all the traffic issues raised by the residents this evening will be reviewed
with the Town’s engineering staff and the applicant. Staff also advised that all other issues will
be addressed in the recommendation report.
Staff confirmed that the application has been circulated to the school
boards. Staff also advised that this
proposal includes additional visitor parking spaces in the underground garage. Staff committed to contacting the Region of
York with regard to the signal timing at the Havelock Gate/14th Avenue intersection.
The Committee
thanked all the residents for coming out to voice their concerns. The Committee requested that staff contact
Ms. Debbie Wong regarding the trees that need replacing along 14th Avenue and Havelock Gate and suggested that if the
trees are the Town’s responsibility then they should be replaced.
There was
discussion regarding the permitted uses for this site and the disadvantages if
the application ends up at the Ontario Municipal Board. The Committee suggested that if the applicant
agrees that a Working Group (consisting of two representatives from the Rouge
Fairway Residents Association, three members from the community, the Ward
Councillor, staff and the applicant) be formed to review the various resident
concerns and/or issues. Mr. Bousfield confirmed that he will speak
with the applicant regarding the Working Group and get back to staff.

Applications for Official Plan Amendment, Zoning By-law Amendment, and Site
Plan Approval, File No’s.: OP 09 113033, ZA 09 113040 & SC 09 113042”
be received; and,
2) That the Record of the Public Meeting
held on September 8, 2009, with respect to “Delpark Homes (Bondbrooke)
Ltd., Official Plan and Zoning By-law Amendment to
permit a 4-storey apartment building at 2 Havelock Gate (OP 09 113033
& ZA 09 113040), be received; and,
3) That a Working Group be established
consisting of two representatives from the Rouge Fairway Residents
Association, three members from the community, the Ward Councillor, staff and
the applicant; and further,
4) That the application by the Delpark
Homes (Bondbrooke) Ltd. to amend the Official Plan and
Zoning By-law 90-81, as amended, be referred back to staff for a recommendation
report.
