(1)        CEREMONY RELATED TO THE APPOINTMENT OF
            DAVID DECKER AS THE FIRE CHIEF CEREMONY (11.0)

 

            There was a ceremony performed related to the appointment of David Decker as the Fire Chief for the City of Markham.  Peter McLeod, Piper, led the newly appointed Fire Chief, retired Fire Chief Bill Snowball, Deputy Fire Chief Phil Alexander, Councillor Alan Ho, Chair of General Committee, Community Services Issues, into the Council Chamber.  Isabella Santiago sang Canada's National Anthem "O Canada".

 

            Mayor Frank Scarpitti introduced the newly appointed Fire Chief Decker and provided a brief biography of Fire Chief Decker. 

 

            Fire Chief Decker thanked Members of Council and staff for their continued support.  He spoke about some of the many accomplishments in Markham Fire & Emergency Services.

(2)        ACCESSIBILITY FOR ONTARIANS WITH DISABILITIES ACT (AODA)
            10TH ANNIVERSARY CHAMPION AWARD (12.2.6)

 

On behalf of the Association of Municipal Clerks and Treasurers of Ontario (AMCTO), Council presented the Accessibility for Ontarians with Disabilities Act (AODA) 10th Anniversary Champion Award to Ingrid Ali, Manager, Diversity and Inclusion, Seneca College.  Ted Moriarty, Director of Human Resources, Seneca College, was in attendance.


 

The award recognizes Ms. Ali's passion for making accessibility and inclusion a reality for people with disabilities in the community.  Her leadership and innovation in breaking down barriers promoted a cultural shift across the province – a transformation that is making accessibility considerations part of our daily lives.

            Presentation

 

1)         That the presentation provided by Brian Lee, Deputy Director of Engineering entitled "Update on Whistle Cessation on Stouffville GO Line" be received; and,

 

2)         That Metrolinx and York Region be requested to agree to safety reports and associated crossing upgrades; and,

 

3)         That Staff be authorized to start the detailed design process; and,

 

4)         That Staff be authorized, if necessary, to front-end the full cost of the design process estimated at $550-$660k for all 13 crossings; and,

 

5)         That staff be directed to hold Community Information Meeting in March 2016; and,

 

6)         That the Mayor & Clerk be authorized to enter into agreements or memorandum of understanding with Metrolinx and York Region for funding partnership for detailed design up to a limit of $660k (including staff administration fees and tax impact); and further,

1)         That the report entitled “Acceptance for Maintenance of Plans of Subdivision” Registered Plan Numbers 65M-4071, 65M-4183, 65M-4221, 65M-4281, 65M-4290 and 65M-4312 be received; and,

 

2)         That the municipal services in Subdivision Registered Plan numbers 65M-4071, 65M-4183, 65M-4221, 65M-4281, 65M-4290 and 65M-4312 be Accepted for Maintenance; and,

 

3)         That by-laws as shown on Attachment ‘G’, be enacted by Council to establish each of the roads within the residential subdivisions as a public highway of the City of Markham; and,

 

4)         That the Community Services Commission accepts the responsibility for operating and maintaining the infrastructure within the subdivisions as part of the City’s system; and,

 

5)         That the Acceptance for Maintenance Period commence as of September 1, 2015, which is the date the subdivisions were eligible for acceptance; and,

 

6)         That acceptance of the subdivisions be taken into consideration in future operating budgets; and,

 

7)         That the by-law as shown on Attachment ‘H’, to amend Schedule ‘12’ of Traffic By-law #106-71, by including compulsory stops to the indicated streets, be approved; and,

 

8)         That the by-law as shown on Attachment ‘I’, to amend Schedule ‘A’ of the Speed By-law #105-71, by including a maximum speed of 40 kilometers per hour for the streets indicated, be approved; and,

 

9)         That the by-law as shown on Attachment ‘J’, to amend Schedule ‘C’ of the Parking of Vehicles By-law #2005-188, by including prohibited parking on the streets indicated, be approved; and,

 

10)       That the Mayor and Clerk be authorized to execute the necessary releases from the terms of the Subdivision Agreements, subject to confirmation from the Director of Engineering that the final two year guarantee periods have been completed; and further,


 

11)       That Staff be authorized and directed to do all things necessary to give effect to this resolution.

1)         That the minutes of the December 16, 2015 Animal Care Committee meeting be received for information purposes; and,

 

2)         That the following recommendations from the December 16, 2015 Animal Care Committee meeting be endorsed:


 

            “That all monies raised during general fund-raising events by the Animal Care Committee shall be deposited in the Committee’s trust account; and,

 

            That the Committee may, at its discretion, periodically donate a portion of its trust funds to the City of Markham’s Cat Adoption and Education Centre; and further,

 

            That any funds raised by the Committee at an event specifically established for the Cat Adoption and Education Centre, shall be immediately donated to the City of Markham to be used exclusively for the purposes of the Centre.”

2)         That the report entitled “Appointment of a Municipal Ombudsman” be received; and,

 

3)         That Council continue to rely on the services of the Provincial Ombudsman’s Office until December 31, 2017; and,

 

4)         That staff report back in the Fall 2017 on the use of the Provincial Ombudsman to investigate unresolved City of Markham complaints; and further


 

5)         That staff be authorized and directed to do all things necessary to give effect to this resolution.

3)         That Schedule 12 of Traffic By-law 106-71, pertaining to compulsory stops, be amended to include all approaches to the intersection of Riverwalk Drive & Fieldside Street;

 

4)         That Schedule 12 of Traffic By-law 106-71, pertaining to compulsory stops, be amended to include all approaches to the intersection of Fred McLaren Boulevard & Stricker Avenue; and,

 

5)         That the Operations Department be directed to install the appropriate signs and pavement markings at the subject locations;

(5)        REQUEST FOR PROPOSAL 084-R-15 FOR
SUPPLY, DELIVERY, INSTALLATION AND
STORAGE OF NEW OFFICE FURNITURE (7.12)

            Report

 

1)         That the report entitled “Request for Proposal 084-R-15 for supply, delivery, installation and storage of new Office Furniture be received”; and,

 

2)         That contract “084-R-15” for supply, delivery, installation and storage of new Office Furniture be awarded to the Highest Ranked  / Lowest Priced Bidder Amovo Workplace Environments (“Amovo”); and,

 

3)         That Amovo be the approved distributor (known as the “Distributor”) of office furniture for all City of Markham facilities for a six year term; and,

 

4)         That Allsteel Furniture be approved as manufacturer (known as the “Manufacturer”) for new office furniture for all City facilities for a six year term; and,


 

5)         That the Director, Asset Management and the Senior Manager of Purchasing be authorized to  finalize an agreement with the Distributor Amovo in a form satisfactory to the City Solicitor; and,

 

6)         That Staff be authorized to adjust the purchase orders in years 2- 6 for a price escalation allowance based on the Consumer Price Index (CPI), Canada All-items, for the previous twelve (12) month period December to December (to a maximum amount of 3.5%); and,

 

7)         That the Staff be authorized to issue a purchase order in an annual amount of $100,000 for Corporate Accommodations or related projects as approved by Council during the annual budget process for the term of this contract; and,

 

8)         That the annual amount be funded from the Corporate Accommodation accounts 750-101-5399-14242, 750-101-5399-15254 and 750-101-5399-16191; and,

 

9)         That future Corporate Accommodation Capital requests will be made as part of the annual Capital Budget process, subject to Council approval; and further,

 

10)       That Staff be authorized and directed to do all things necessary to give effect to this resolution.

(6)        MARKHAM CELEBRATES EARTH MONTH
– 2015 REVIEW AND 2016 PLAN (12.2.6)

            Report

 

1)         That the report titled “Markham Celebrates Earth Month – 2015 Review and 2016 Plan” be received; and,

 

2)         That Council thank the Markham Environmental Advisory Committee (MEAC) and all volunteers for their efforts during Earth Month Celebrations 2015; and,

 

3)         That Markham declare Earth Month Celebrations 2016 to be from March 19th until April 30th, consisting of the following events:

 

a.       Earth Hour at Cornell Community Centre and Library on March 19th, 2016; and,

b.      Earth Month Celebration lead by MEAC at Markville Mall on April 23rd, 2016; and,

c.       Keep Markham Beautiful community clean up events held throughout the month of April; and,

d.      10,000 Trees for the Rouge annual habitat restoration event to be held on April 24th, 2016; and,


 

4)         That the estimated 2016 costs of $148,200 for the above events will be funded through sponsorships and approved capital projects “Markham Trees for Tomorrow” and “Greenprint Community Sustainability Plan” up to the amount of funding received; and further,

 

5)         That staff be authorized and directed to do all things necessary to give effect to this resolution.

(1)        REQUEST THE GOVERNMENT OF ONTARIO
            TO LIMIT THE JURISDICTION OF THE
            ONTARIO MUNICIPAL BOARD (13.2 & 10.0)

Whereas the City of Markham spends an incredible amount of resources and taxpayer money developing an Official Plan; and

 

Whereas the City’s Official Plan is ultimately approved by the Province; and

 

Whereas it is within the legislative purview of Municipal Council to approve Official Plan amendments or Zoning By-law changes that better the community or fit within the vision of the City of Markham’s Official Plan; and

 

Whereas it is also within the legislative purview of Municipal Council to deny Official Plan amendments or Zoning By-law changes that do not better the community or do not fit within the vision of the City of Markham’s Official Plan; and

 

Whereas planning decisions may be appealed to the Ontario Municipal Board (OMB), an unelected, appointed body that is not accountable to the residents of Markham; and

 

Whereas appeals of OMB decisions are limited to questions of law, not the findings of facts in a case; and


 

Whereas all decisions—save planning decisions—made by Municipal Council are similarly only subject to appeal by judicial review and such appeals are limited to questions of law; and

 

Whereas the recent Provincial anti-SLAPP legislation (Bill-52) in support of democratic participation, does not apply to the OMB. A SLAPP lawsuit (Strategic Lawsuit Against Public Participation) covers court litigation.  Since the OMB is an agency of the government, not a court, the anti-SLAPP legislation is not applicable causing financial hardship to community groups facing court costs;

 

Now therefore be it hereby resolved:

 

1)         That the City of Markham Council requests the Government of Ontario to limit the jurisdiction of the OMB to questions of law or process; and

 

2)         That the Government of Ontario be requested to require the OMB to uphold any planning decisions of Municipal Councils unless they are contrary to the processes and rules set out in legislation; and

 

3)         That the Government of Ontario be requested to apply the Provincial anti-SLAPP legislation to the OMB; and

 

4)         That a copy of this Motion be sent to the Honourable Kathleen Wynne, Premier of Ontario; the Honourable Ted McMeekin, Minister of Municipal Affairs and Housing; the Honourable Patrick Brown, Leader of the Progressive Conservative Party; the Honourable Andrea Horwath, Leader of the New Democratic Party; and all MPPs in the Province of Ontario; and further,

 

5)         That a copy of this Motion be sent to the Association of Municipalities of Ontario (AMO), Federation of Canadian Municipalities (FCM), York Region Council and all Ontario municipalities for their consideration.

 

            Note:    This notice of motion will be listed on the March 1, 2016 Council Agenda for consideration.
